And that, ladies and gentlemen,is the basic point some of us have been trying to make;although in vain..

I guess my biggest problem is that it can be a paycheck killer if you are not being paid the way we should be paid.

OK lets not confuse the Minnesota courts ruling--and the possible federal EOBR--they HAVE NOTHING TO DO WITH EACH OTHER--what the Minnesota court found the Patrol to be in conflict with the constitution was the Patrol's methodology--the guidelins they were using to make their determination--much akin to illegal search and seizure--there is no reason to rehash this here(although Im sure you will--LOL)
What you must understand--is we work in a federally regulated industry! and please don't bring up deregultion--which ONLY dealt with rates and authority!
You personally may have a constitutional right to privacy--but the TRUCKING INDUSTRY DOES NOT--therefor IF the FEDERAL DEPORTMENT OF TRANSPORTATION DECIDES--in the matter of safety you will have a recorder or sat gps or whatever--this industry has NO CONSTITUTIONAL recouse--of course this ruling can be challenged in court--just like the HOS--but it cannot be challenged constitutionally-everbody loves to get on the this is UNCONSTITUTIONAL bandwagon--now I have said it before and I'll say it again--As a driver-(or any other type worker)in a REGULATED INDUSTRY--you have no constitutional rights when it comes to following and obey rules and gudelines--yes you still have all the personal right guranteed--free speech--reasonable expectation of privacy etc....but when you volunteraly choose to enter a profession that has rules and regs etc--you accept the limitations placed on that industry--no different than a pilot with a black box or a window washer required to wear a harness--well wearing this kind of harness infringes on my freedom of movement and I have a right--yup you have a right to NOT take the job in the first place
Remember this post has nothing to do with my personal thoughts--feeling--or beliefs--I only posted it to make everyone think--and so some of you might stop with the constant flawed arguments and reasoning.
Thank You -
Actually will there ever come a time when a driver starts running with 2 Elogs instead of 2 paper logs? -
I don't need to run illegally. My problem is that the feds and a few of the major carriers want to force me to spend several thousand dollars (potentially, since we still don't know the actual cost) to purchase a product and to pay a monthly fee for something that I am quite capable of doing myself at a fraction of the cost. It is not a matter of not being able to log legally. It is a matter of being able to choose how I log my time. It is a matter of making a decision about my own business about where I want to spend my money. There is more to this than just putting in a recorder in your truck. Somebody has to pay for it. In my situation, it will be me. And, yes I have a problem with anyone trying for force me to spend MY money. Those who like the idea of somebody else spending their money for elogs are probably not going to be the ones who will write the checks. -
Frankly it is the only reason we haven't been forced to do this quite awhile ago--considering how 2-3 of the most powerful members of the Senate have been pushing it for years -
There are already people on this board confessing and whining they have been caught driving on a team drivers book. They in fact lost their job for such actions. I'm sure if it becomes prevalent the penalties will escalate to the point of license, and possibly authority suspensions.
All the while those caught ranting and raving how it is an unconstitutional money grab by filthy pigs -
Do you have a problem with the regulations mandating drug tests?
DOT physicals?
Annual inspections?
Records of Duty Status?
Tire's with certain tread?
Mandating certain light configuration?
Mandating insurance?
You chose to operate on a public roadway. You in fact asked for permission. That permission is conditional and part of the conditions is compliance. This is a tool that supplies a higher degree of assuring that compliance that while still slightly flawed (on team operations) is a better tool than easily forged, relatively cheap and accessible paper counter parts.
Yes the big boys do have the technology in place for the most part. And they paid to be in that state of readiness. Same as you will when it becomes final. -
tdcanterbury67 Thanks this.

We have been keeping paper logs for many decades. This industry has thrived in spite of having paper logs. How have we have gotten along for so many years without elogs?
The thing with logs is that there are two ways in which logs may be kept. We can do paper logs or elogs. It should be a choice. Both accomplish the same goal of tracking our time.
