Ok drivers I know I've posted this previously, but here it is again. LISTEN TO LOGSRUS on split breaks. I learned it from her printouts 5 years ago and have never had a problem. I'm not afraid to use a split because I understand it. I use them frequently.

Got a ticket in Washington over using 8 + 2 (sleeper birth provision) please review my log book and let me know if i violated as according to me there is no violation and officer stated that there is no 8+2 provision it got to be straight consecutive 10 hour sleep and put to out of service. Had to take 10 hours sleep
Please let me know if you find any violations if you know how sleeper berth provision works

Starting at 1115 on the 17th you ran a cumulative 8.75 hrs on your 11-hour clock (leaving 2.25 hrs) and 12 hrs on your 14-hour clock (leaving 2 hrs.) You then took 8.5 hours continuously in the sleeper. A conservative reading of the rule gives you 2.25 hours to drive and 1.5 hours to do it in.
So you ran 1.0 hrs on line 3 and took a break after 1.5 hours on your 14-hour clock. I see that as legal.
The 11 and 14-hour clocks are now calculated from 0745 on the 18th. At the end of the 3-hour break on the 18th, I see that you have 10-hours to drive and 9.5 hours to do it in.
You then drove 5.75 hrs leaving 4.25 hrs on your 11-hour clock, and went into the sleeper berth before your 14-hour clock expired. Looks completely legal to me.
You need to do a Dataq on this (submit your logs) and get it reversed, and fight any ticket the flatfoot issued. You might want to consult an attorney on this, and see what he'd charge to do it - I've heard that there is a better chance of prevailing in the Dataq process with one.raja209 and scottied67 Thank this. -
Question if I start my 8 in sleeper birth with 7 hrs on my 14 wich would have normaly been up at 6pm i extend the 14 until 12 midnigth and then take a full 10 can I start a whole new 14 after the 10 is up.

Yup... the 10 resets both your 11 and 14-hour clocks.

I don't believe I responded to this but no you was not in violation!
Your 14 hour clock originally started at 11:15 am on 3/17. 14 hours later is 0115 on 3/18.
You took a 8.5 hour sleeper break, that extended your 14 hour from 0115 for 8.5 hours which makes
your 14 hour now end at 0915 am on 3/18. YOu stopped driving by 0915 and your total driving from 11:15 am until 0900 was only 9.75.
You then took a 2 hr break.
That rest your 14 hour clock to start @ 0745 on 3/18, 14 hours later is 945 pm. You stopped driving before 9:45 pm. Your total driving from 0745 to 6:30 pm was only 6.75 hrs, which is not over 11 hours.
the officer was wrong. Sorry I didn't see this sooner .
Now with the above said, it's a good example for other drivers to read today as we have a 2 day example of a real log.
but if you are a local driver following washington hours of servie, this could be a different situation. It doesn't seem you are though by your logs.scottied67 Thanks this. -
