Fuel Card provider Comdata has just settled a class action lawsuit which will pay independent truck stop owners a total of $130 million, $100 million of which will come from Comdata, the other $30 million from Pilot Flying J, TravelCenters of America, and Love’s Travel Stops.
The class action suit was brought against Comdata in 2007 by Marchbanks Truck Stop, a small independent stop in Pennsylvania, who discovered that independent truck stops were being charged five to ten times more for the same service that the larger truck stop chains were using.
The suit has 4,000 class action members, all of whom will be receiving the benefit of the sizeable settlement.
Comdata’s CEO and Chairman, Stuart Harvey, Jr., said in a statement that “While Comdata believes the lawsuit lacked merit, we decided to resolve the lawsuit so that we can continue to focus our full attention on strengthening and growing our relationships with our merchant and fleet customers.”

Independents were being charged 5-10 times more for the same services. Well, at least it has come to an end now. I guess that explains why so many of them don’t accept Comdata. Maybe now more of them will.
True but do you really think $32,000 is a fair amount? Something tells me they lost far more over the years.

Simple math….
130,000,000 / 4,000 = 32,500.
But it will be even less than that after the lawyers talk 50% or more for themselves.

One of the nice things about class action lawsuits the defendants pay the lawyers fees and the settlement goes to the plaintiffs (the truck stop owners in this case) .
The ugly side of class actions is the fight is usually amongst the lawyers in how much money the lawyers get paid. If you think greedy plaintiffs lawyers are bad try being the corporation that has to pay their own overpriced defense lawyers. Corporate defense lawyers bill by the hour and boy do they bill. And in class actions they will fight for every penny of the lawyers bill so they can bill more hours.
