The Long Beach Harbor Commission ruled on the side of law by rejecting an appeal trying to break its settlement agreement with truck operators, reported the Journal of Commerce Online.
Long Beach city attorney Robert E. Shannon responded Nov. 20, rejecting the Natural Resources Defense Council’s appeal on grounds that “the appeal conflicts with the express terms of the Court Order in which the Federal District Court retains exclusive jurisdiction and venue.”
The port’s settlement with the American Trucking Associations (ATA) removed the controversial concessions agreement from their implementation of the Clean Trucks program. The concessions would have required independent truckers to become employees of companies. The settlement was attacked by environmental and labor groups, including NRDC and the Teamsters.
Shannon added that the appeal wasn’t submitted within the time window for such proceedings.
