Despite the recent surge in the fight against ELDs, it looks like the compliance date will stand. This week however, the Commercial Vehicle Safety Alliance announced that enforcement officials will give carriers a break on giving Out of Service orders for ELD violations until April of 2018.
“After Dec. 18, 2017, if you don’t have an AOBRD or ELD the violation will be cited, and a driver could be fined, but they won’t be put out of service. Companies that continually violate the rule could be subject to federal investigation as well,” says FMCSA spokesperson Duane DeBruyne according to Overdrive.
According to the CVSA, the Federal Motor Carrier Safety Administration is on board with their enforcement plans.
The delay may act as a sort of barometer to see how many carriers are actually in compliance with the rule before handing out OOS orders left and right.
But while the delay is meant to give carriers a little bit of wiggle room in adopting ELDs, getting cited for a violation will still have major consequences. The policy won’t actually protect drivers from getting cited or fined. And citations will count against a carrier’s safety rating. All the policy does is prevent drivers from being placed out of service.
Trucks will be considered in violation of the ELD mandate under the following circumstances:
- If the truck is not equipped with an ELD
- If the ELD in the truck does not meet FMCSA specifications and isn’t found on their certification list
- If the driver is unable to produce data for – or transfer data to – law enforcement officials
- If a malfunctioning ELD is not repaired within 8 days
- If the driver has not properly logged in to the device
The ELD compliance date is December 18th, 2017.

is there an exemption for oil field
No, oil field services must comply with ELD manadate as well. The only exemptions I know of is the intrastate 100 air mile rule (100+ depending on the state )
There are exemptions with HOS with oil field services but one still must comply with ELDs/ AOBRD if one was grandfathered in.

My training good few years ago was 5 days with trainer who was catching up with his sleep while “training me”. I drove about 1 million miles accident free ever since.

Can you post 700 mile days if it takes you 2 hours to unload and another 2 to reload. I load and unload my truck everyday. Not 2 or 3 times a week. What works for you may not work for me, and vice versa. Lots of scenarios.

Find a percentage paying outfit, and negotiate your true worth. I bet you don’t see no checks over $1500. ELD can be the tool that allows all drivers to stand together. Old school vs new shot is stupid. For example: I’m on ELD’s I drive on average 2200 mile every week home Sat. And Sun. and get paid $1 per mile. Change you hustle not the game.

All big companies are hacking with their logs due to ELD’s for long time, I use to work with Werner and some times they use to come up with 6 or 7 hours out of no hours left. Know every driver will be able to do that shit. Concept of logbook is going to be a joke. ELD is a waste that will become uncontrollable. Not a good thing for road.

A lot of drivers take off for the holidays anyway. More are refusing to use ELDS and leaving trucking altogether. The holiday flow of goods and services will be interrupted anyway. So forcing compliance with ELDS at Christmas time forces drivers to make personal cutbacks and that hurts the already fragile economy.
I can not wait to see what the upper class says when they can not get their favorite coffee beverage anywhere and are told the supply has run out and it could be months before it comes back in line with demand. Fright will be stalled in harbors and rail yards because the short/medium hall owner operator already getting squeezed now has to buy and upload logs to comply. That’s puts the whole worse case scenario into effect. Plenty of demand no supplies moving. Then we will see how the public feels about truckers and truck stops. The upper class will scream all the way to Washington. Then maybe we will get some respect.

Hate to inform you the LAW has PASSED the argument now is implimation ! My question, which thus far no one seems to be able to answer is what information is going to be transmitted by WIFI to the peace officer, or who ever has the electronics to upload from the ELD, which I have been assured there is no recorded proof of the identity .

Problem is there’s those of us little owners that would gladly shut down but there’s so many illegal companies and crap rate companies that their trucks would pick up the slack and it would hardly get noticed. Unless we really converge on DC all at once.
Jon Toscano- I’m with you on shutting trucks down, BUT, that very reason is why they are so adamant about turning the industry into automated (driverless) trucking. Familiarize yourself with it, they are already doing. Wont be a need for eld’s because trucks are driving themselves.
I’m so glad to see the implementation of ELDs. Should take care of the pushy dispatchers and make out highways safer. Hopefully will slow down UPS, FEDEX and expediated cowboys.

It is clear YOU have not been in the trucking world very long. ELDs are so easy to manipulate, the dispatchers, as well as the company operations manager will handle the logs by making sure YOU are driving the hours and getting the miles THEY want whether the hours are exact is not a priority for them, it is getting the load to the destination.

Smaller companies won’t be able to make it as they will be forced to increase their fleet just to service the contracts they already have. This is cost prohibitive.

And when you do that you can forget about delivering or loading any freight from the state of California, and soon the state of Washington and New York ! For the remark about the Vin being 2000, the rule is attached to the engine not the truck. The guy said he was having an early model engine installed in his 2014 Volvo, thinking he is going to be accepted as an exempt vehicle, not so, If the unit in question can be verified as a KIT, which is a incomplete new vehicle to replace a totaled wrecked unit, with the major components installed from the wreck to produce a usable vehicle, with a considerable savings to the Insurance Company, or trucking company. They did do their homework too !

I worked four years like company driver for small trucking companies in Chicago (less then 150 trucks). They call them “russian”. But they are not russian. They are lithuanian, polish, ukrainian, bolgarian, uzbekistanian and etc. Never saw russian companies. All these companies have special departments (they use keeptrucking app for logs) to FAKE paper logs online on driver’s keeptrucking apps on their cellphones. Usually drivers with keeptrucking app drive 4-5 thousand miles solo and they never drive legal. They are always tired and drowsy. About 80% sleepy drivers are on the road right now. I do not want share road with them, because its unsafe. Those companies and dispatchers push you to drive unlegal. I never fake my log. I drive 2500-3000 miles per week legal. They do not want me to drive with accordance with DOT regulations. They do not need it at all. Money, just money. And every time i have conflict with my dispatcher. I need equal terms with other drivers.

There are always loop holes to the system. My husband and I are about to purchase a truck and we will be running nothing newer than a 99!! What DOT needs to focus on regulating are all these CDL schools that are just handing these student drivers their licenses. And the trucking companies that allow someone to operate a truck by themselves with 4 weeks of training. That is the real issue people, it’s not the logs!

to off duty break at truck stop. I can’t fill out his logbook. I won’t hold his hand either. A thirty + year old. Refused to drive back, even a small distance, to show his driving skills. Went to sleep four times on the

All ELD Qualcomm and PeopleNet will be adjusted to 5 miles per hour DRIVE Time detection. Right now companies have 10 miles and 15 miles per hour drive time detection but till December 18, 2017. THIS IS RIGHT ATTITUDE, this is the answer, unless you are hauling over size, or within a round trip of the legal speed limit of state you operate in. Team drivers who confine their time to 10 and 2, 5and 1, can practically run indefinitely, within the 7 day in 8 day rule. The trick to this is you must work for a company that does not have a greed issue. and sees the value of set out loads. Teams purpose is defeated if they are required to live load period ! I was part of a research project, lasted 3 years, and proved an increase of truck revenue of41%, with a raw labor increase of 25%, put you pencil to that!!!
Do us all a favor hire a new driver and teach them the right things they need to know about trucking that you had to learn by trial and error, and insure the future of a profession that is as old as the model A .

Drivers running multiple luv books to make money is what’s keeping rates so low. Finally a chance for shippers to pay up.
Truly safe trucking will never exist. To improve safety, three things must happen. The first would be to divide the country into six regional zones. Drivers would be limited to driving in two zones only. This would mean a driver would gain familiarity with his environment much quicker. It would (or could) mean more home time for the driver as well.
The second thing would be to require each driver no more than one DOT inspection each quarter, and of those 4 inspections, no more than 2 could be class A inspections. (This would be dependent on the driver having passed their previous inspections and a companies DOT rating being solid.) Once you’re inspected in any given quarter, you can’t be pulled in randomly again during that quarter. You would bypass all scale houses, whether open or closed until the next quarter.
The third thing would be to create truck ONLY lanes on all interstates as they pass through cities. They would be for drivers not planning to stop, or have a load to drop in any given city. This lane(s) would preferably be the most outer lane(s) to allow the truck driver to not have to deal with merging and exiting traffic. And again, be strictly for commercial trucks.
Of course there are many other factors that affect safety for truck drivers. But, with the huge increase in traffic that has occurred across this whole nation, reducing the stress endured by professional drivers has to considered. A less stressed out driver is a more responsive, more confident, and more relaxed driver….translating to a safer driver.
Drivers don’t race against hours on paper logs because we never run out of hours, with eld’s, well that’s a different story, they will drive like crazy to squeeze every minute, I see more wrecks coming, and to be a trainer, I believe a trainer should have 5 or more yrs of OTR experience
U guys realy need to read the eld ruel ,it plainly states motor vehical manufacturered 1999 and below based on vehicle vin # dosent matter what year motor u put in ur truck , it is the manufacture date of the truck !!!!!!!!!! If that was the case all the gliders out her that have pre 2000 motors in them could stay on paper ,,,, i know this for a fact ,,, have checked it out ,,, and verified it with dot not a web site or hear say ,,,, all my trucks are 99 down and will stay on paper !!! ,,, comment all u want ,,,, deni it all u want that is the ruleing as of now !!!!!

Instead of focusing your animosity on the government, you should focus more on the driver managers, load planners, driver ops manager, there the ones who need to be held accountable, most of them have a hard enough time planning what there going to have for lunch, let alone planning a drivers hours and trip, these are the ones who ultimately don’t give a rat’s ass about anyone else but themselves….. And these shippers and receivers really need to have the screws put to them, look at Walmart, there handing out huge fine for being early or late, but how often do you sit when you make your appointment time???? And that goes for a large amount of shippers and receivers. You want change, your have to start at the origin, the place where you receive you paycheck!!!
Last word, the only way any of us is going to make a decent living and have hometime is to go hourly, that way when were held up at shippers and receivers and or traffic and bad weather, were still making our money regaurdless of any situation where as it stands now, were the ones who have to eat the loss, it’s high time for your company and others to pay for our lost time!!!

Money Money Money. If they really wanted to make the roads safer they would require more training for newbies. There’s an easier way to stop the supposedly Unsafe Outlaw Drivers. That’s getting rid of the outdated CPM pay start paying by the hour problems solved. Drivers wouldn’t be in a hurry anymore or be forced to drive over there hours to make more money. If driven almost 18 years and I’ve been behind the wheel of numerous triple digit trucks and and times I admit I’ve driven pretty hard because the only way to make a comfortable living is get there fast. But I’ve never driven faster than my ability or put anybody in danger. Now look at most of the bigger companies mostly under 65mph and those damn ELDs and look at the safety records. You past them up on the highway because your truck can actually do the speed limit and what happens when you hit a town that JB Hunt or Celadon truck you past at highway speeds is hammered down running through town. And why because if he slows down to city speed limit he might lose a couple of minutes off his clock. You got 11hrs to drive in a 14hr window so you got to keep a steady pase what if you get sleepy can afford to pull over and take a little nap because your clock will still be running. The dispatcher is sending you message after message wondering why your not rolling because legally you still have 3 hours left to drive but for some other circumstances your dead ass tired and desperately needed some sleep. Safety is important in this industry and the FMCSA and the ELD mandate is going to make an already dangerous situation even worse.
H.R. 3282. That’s the real story. Come on Drivers call your Congressperson for support and quit babbling on Truckers Report. Shoot you all think Truckers Report is doing you any favors NOT reporting on H.R. 3282 and writing propaganda about an OOS extension to feed you morsels of hope ?
I’ve done paper logs, I’ve done electronic logs. There wasn’t that big of a difference. I do agree that they should go after customers but it won’t happen. If you want to maximize your money, deliver in the morning, on your 10 hr break, and start your clock after 12. The bulk of your driving hours will have less resistors, scales closed, no four wheelers, etc. It’s all about use of time.
I am disabled about 12 back surgeries to neck surgeries and got a stick I drive cross-country and drive a grain truck I load and unload everyday some days I feel like getting in my truck and driving for 3 hours and then I’ll have to get my sleep and put my brace on some days I feel like driving for 10 hours and then stopped and putting my brace on but I wonder who would rather be paying my bills for me y’all or would you rather me being a truck with the e-logs are really going to make it hard for me because on the days that I can’t drive with a couple hours and I get sore it’s going to be hard for me cuz I’m going to lose my time that’s the only thing I see that are trying to work and not sit at home on the couch and make you all pay our bills because all y’all do is
