Ever since the ELD rule went into effect on December 18th, 2017 – and even before then – the FMCSA has been granting waivers, exemptions and delays for certain companies and segments of the industry. So, while Old Dominion being given a 90-day compliance waiver seems like business-as-usual, the reason given in the FMCSA notice might be anything but.
In their delay request, Old Dominion Freight Line Inc. claimed that the company is having difficulty adjusting to the new ELD software from their provider, PeopleNet. Because of those difficulties, they feel they should be given a delay of 90 days to get everything sorted out.
Several other carriers and trucking groups like OOIDA have made similar requests: ‘Give us a delay on this regulation until we and the ELD providers can get everything working properly and figure out how to use them safely and efficiently.’ Many of those requests were denied or are in comment period limbo.
There are many factors that go in to the FMCSA deciding on a request like this. One major factor is safety equivalency – if a request is approved, will it result in “a level of safety that is equivalent to, or greater than, the level of safety that would be obtained in the absence of the waiver.”
Since Old Dominion is already equipped with Automatic OnBoard Recording Devices (AOBRDs) and has been since 2011, FMCSA determined that they would be no less safe running without ELDs.
But the second criteria, whether approving the waiver “is in the public interest,” is where things get interesting.
According to FMCSA, if the waiver was not granted, Old Dominion’s operations would be interrupted. And for a company that large, an interruption would not be in the public interest.
“In the case of Old Dominion, the company has 228 service centers located throughout the Nation and operates a fleet of more than 8,500 power units. The company employs more than 10,000 company drivers. It is in the public interest to avoid disruptions to Old Dominion and other carriers’ operations and, subsequently, a disruption to the movement of a significant amount of freight. “
According to its website, OOIDA counts 160,000 truckers among its members, “who collectively own and/or operate more than 300,000 individual heavy-duty trucks and small truck fleets.”
Despite that however, OOIDA’s request for a waiver on behalf of small trucking companies still has not received a decision.

Old Dominion is bigger than the company I work for and they get ELD waiver. They have no excuses for not being compliant two years ago. Nobody has an excuse for not being compliant no matter company size.
And the thing is the article said that OLD has had ELD’S since 2011, so I don’t get what the problem is.

This whole issue is a bunch of Huey anyway. It is about government overreach. I run a small fleet of 50 trucks, and to honest, even the D.O.T. inspectors in the field do not know which way is up in regards to ELD’s. I have 5 trucks that are 1989 Peterbuilts, fully restored show trucks, that are exempt due to not having the onboard computers needed for ELD’s, and I get hassled for not having the ELD’s. It clearly states that 1999 and older are exempt, and many inspectors are still ticketing my trucks, resulting in legal fees that I Have to pay FOR NOTHING other than ignorance! As usual the government is stepping on the little guy, trying to be legal and earn an honest buck. FED UP

What a load of crap, you had two years. They we’re betting on getting this over turned, and lost.
Says they already had aobrd devices. They knew it was coming just like other carriers big and small, how hard would it have been to work the units through a terminal or authorized service center to have the peoplenet installed? My company has a fleet of 20 trucks and had Qualcomm installed back when the rumors started it was going to be mandatory.
Because PeopleNet doesn’t work properly. Neither does other companies selling ELD units. We bought one from a reputable company last year and it hasn’t worked yet. They to,d us they were aware of the software issues so just run paper logs. No eta on a time.
They should just leave small trucking companies alone. It is all just a HUGE money making scheme that the big companies like because they get kickbacks. Money talks and the little man just gets kicked in the nuts!!
OD, and companies like them have known this was coming for years now. They have been dragging their feet because they were afraid of how it would effect the way they run. Also, their drivers have been fighting the transition. They should be fined because they didn’t meet the deadline. People net excuse is lame.
They aren’t having a hard time. They were hoping the law would be repealed by Congress. They took a gamble…they lost. Now they are sitting there wondering why the bookie (FMCSA) is there breaking their kneecaps. Either settle up or get out of town.

Don’t think old Dominion got the waiver for nothing. It’s all about money. No matter what size company you are, if you have one truck and the money to pay out for a wavier you will be granted a wavier. So old Dominion can and any other company can go a whole year if they have the money. Soon as the money is gone no more waiver. And for the disruption of freight and operation it affects every company from a one man truck company to a eight thousand unit trucking company. We all do the same job and get paid pretty much the same. Safety is not the issue it’s controlling the industry and keeping everybody on the same playing field.hell old Dominion need 90 Days to get use to and understanding how to use a ELD ? It will take a good 4 day to a week to understand the ELD.
Like many of the government’s involvements, this will end in disaster for many industries…reefer rigs in particular as perishable items do just that.

As long as you put new drivers in big trucks with automatic transmissions with know respect to the 🚚 and the size and weight. There will be know changes on how safe the highways will be.
Elds are not the problem i prefer them its easier to log the problem is the hos we need to be able to stop our clock if we are in the sleeper for 4 hours at a customer so it doesnt eat our drive time. They are fighting the wrong fight.
Exactly David! I don’t mind the ELD either. The problems come from waiting at these shippers docks. None of that time should count. Especially since most drivers actually get a good nap while there. Ive been at a dock for 6hrs before. SMH Especially at these food DC’s. Maybe even just make the 14 all the same with a 1hr break. Another issue is trying to find a parking spot!!!
Good for you. Keep your ELD. I guess yours goes to give you hours of service violations out of the blue and your system doesn’t crash every 15 minutes and reboots and gives you another violation. It lets large companies play GOD with your livelihood. I’lol bet you don’t mind camera’s either watching you scratch your nose or GOD forbid-smile. You get called into the office about it because they have a screen watching every truck driver the whole friggin time. You are questioned on what you are smiling at and give you a warning to not do it again. I thought that wasn’t allowed either, but it’s being done. Big Brother is Watching!

I havent driven as tired as I have since Dec 18 2017. I am a person that can sleep maybe 5-6 hrs. Yet I stop every 4-6hrs or so and go back and take a nap for an hour or 2. Due to this ELD I cant do that anymore because of the damn 14 hr rule. I have a dog and I cant get out and walk him properly so I am rushing him and we get less exercize. So after 29 yrs of safe driving I am quitting Feb 1st. Im too young to retire yet pretty old to start a new career but Im not going to continue driving tired and unsafe.
Debra i use to wonder why these company drivers/o/o on the ELD are so crazy riding down the road rushing. Now I know you have no time to take it easy you got to keep at it to stay on schedule. Especially if there were traffic issues which robbed you of time. Also Got to have a PLAN which will fall apart at times lol like show up somewhere and they say oh you can’t park here go down the road come back 30min before appointment.

Old Dominion knew about this mandate two years ago so they have no excuse, I agree…But using this same principle we have to man-up to the following…

Finally, the ELDs have brought the REAL problem to the fore-front…the hours of service. If you can hang in there, Debra, I wouldn’t be surprised if the regs aren’t relaxed soon.
I have only been driving six years but like you, operate on short periods of sleep. I am generally awake at least 3 hrs before my 14 hr resets.
I have been driving over 40 years and I have no problem with the E.L.D.’s. I was frightened when we were told to use them but now I am used to it and have no problem . I also get about 4-5 hours sleep per night and I only use my alarm clock incase I over sleep. I wake up the same time every day even on my day off ( but I usally go back to sleep ) .
My problem is . .I have found my self sitting in side getting loaded or un loaded.. and violate the hours of service. And when I first got there.. I would have like …four hours. Wht works on paper don’t always work in the real world.. that all I’m saying!
Eld compliance is ” not ” about safety!!! I find that it pushes the drivers too hard to get to their stop, which makes it dangerous. At least before eld they could stop and rest an hour or two.
We need some other Hos system ,maybe 11 hours of driving in 24 hour period.???
So true! ELD dehumanize us bc we “function” like robots with no need to rest for 1-2 hrs. Who can be satisfied with a 20 min “power nap”! Not even a lunch break is enjoyable. Of course it’s NOT about safety. If FMCSA and DOT cared about safety at all, they would broadcast programs to educate the 4-wheelers how to behave around rigs. It will get worse during spring break and summer vacation. We have seen lately the anxiety at pumps and the increase of speed + more accidents on slick roads due to rushing stressed out truvkers. Stuckraffic then stuck at a dock for hrs, then a bit of driving, more sitting at a dock then a 10 hrs leizure for nothing. They want us to work an over full time job with the income of a part time job! It’s all about them monitoring our activities, reducing our income, smashing the small carriers, promoting the monsterous corporations (since they realized that many drivers have preferred the minor companies over the last years.. which alerted the government). It’s about the absolute control of the New World Order. The “white collar” yappies had already smelled that Transportation has $$$ so we, the modern slaves, give our milk like obedient cows to those blood suckers – office rats – balls scratchers. Now it’s getting way worse. I believe it’s not worth it anymore. Only if and when the shelves of the super markets start having big delays on restocking (fresh produce, fish and meat and toilet paper) those fascists might reconsider.

When ELD came to Europe, the 40% of truckers quit and never came back. It’s the New World Order at it’s experimental best! We expect worse… The smart ones have found a job at a warehouse! As we all see shippers and consignees have not adjusted the pace of their loading – unloading customs: balls scratching, cellphone playing, last minute tags correcting. Im not surprised bc nobody ever protests in USA.
For clarification, Peoplenet is pushing out a software update to convert the existing hardware from AOBRD to ELD, and it has an entirely new user interface.
I have seen it but not yet used it, because they haven’t pushed it to my fleet yet, but I didn’t like what I saw initially.
I would guess that OD tested the new software and found it lacking, or it didn’t play well with their existing back end systems, and so they are wanting time to work with Peoplenet to fix the issues.
This makes it more of a Peoplenet issue, but even they are not fully to blame, since the final rules haven’t been out that long, and so they have had limited time to finalize their software.
It is different for the independent drivers, because they are all using so many different companies, and so there is no specific technical issue like Old Dominion/Peoplenet has, plus they aren’t already running a perfectly serviceable system already, and just requesting time to change to the new version that does basically the same thing.
ELDs are not the problem, it’s the 14hr rule,parking,HOV lanes,etc…When they made this law none of them considered any of these problems, for example, HOV lanes should be Truck Lanes so we can get thru these congested Cities without wasting hours of clock, all shippers and receivers should supply overnight parking and all truck stops should stop charging to park and we should be able to stop our 14hr clock when getting loaded or loaded
How will you make shippers accommodate you, Floyd? Lots of them don’t have room for overnighters, some are restricted by laws, and the almighty insurance companies would go nuts over possible liabilities.
Instead of stopping the magic clock, the 14 hour crap should be thrown out. Period. Somebody in an office decided that driving should be an 8 to 5 job, so maybe you should go park at his house.
The problem is overregulation, together with greed in all segments of the industry. If the main idea is to kill the economy, it will happen soon.

The ELD has to many problems that need to be worked out . Mine kept loosing connection and I lost all my logs . And was told you can’t keep two logs . But thank goodness I had mine for back up . I don’t want fined for this problem they need to fix .

I agree with many of the comments already posted. E logs are not the problem. Beginning in the 80’s virtually all trucks have had the ability to track and record the operations of the truck. In the event of an accident, one of the first things checked is the ECM. So, accountability has been there for years. HOS rules are where improvements and changes need to be made. Traffic, Customers, weather and the driver’s actual “internal clock” make current HOS regulations difficult and at times unsafe to work within. We all want to be safe but everyone is not the same and the way they need to work and live is different. A 14 hour day is plenty, we just need to allow that as a total combination of work and driving. Trucking companies would do better, drivers would be able to make more, and the Customer would see a better level of service.
Nothing new mega fleets always got some one in there back pockets.

Why should everyone be force to use the eld when the companies the work hard on keeping a good saftey record by keeping their equipment up to standards keeping their paperwork up to date like their PAPER LOGS up to date. Have been working hard obeying the law. Just cause you us paper logs doent mean your Lying on your logs. Its the bad companies out here that need the elds because they care about making a profit than safty they take a driver thats been driveing for a few months and turn him into a trainer realy a Rookie training a rookie. And yes the hours of sevice need to be changed too. If a campany needs to track a drive see what hes doing than my be hes not the guy for the job. If they would pay real money then they would Attract real drivers. Why would you hire someone you need to Babysit all the time.

At 2 pm I drive 45 minutes to get shipper.
..wait 2 hours to get load it…drive again 3 hours to get Receiver but I have to wait 6.5 hours in truck stop 3 miles away because they dont have parking space for us, Im at sleeper Berth but cannot complete 8 hours straight and that’s killing me because 14 hours keep going….For people like me that runs only 2 or 3 hours at day its not working ELD cuz Im not fatigue at all.
The ELD is causing a safe driver to become and unsafe driver. Drivers are now UNABLE TO CHOSE TO STOP and have a bathroom break and a cup of coffee when they feel the need for a short rest and refreshment. Driver’s are having to DRIVE FASTER because they will RUN OUT OF TIME before they arrive at a realistic location or unloading point before their hour of MANDATORY SHUT DOWN. Being able to take a nap after getting loaded or waiting for the “4 wheel work traffic” to die down is no longer an option. This is going to cause MORE UNSAFE DRIVING than there has ever been! STUPID bureaucratic rules made by ignorant fools. KEEP IT SAFE DRIVERS!!!

It’s the 14hr rule plane and simple. It makes a driver race the clock from the time he or she pushes the button to the time when he or she finds a parking spot at the end of the day. It’s a constant “race” to get everything done during the day. Very unsafe. It’s obvious the 14hr rule was implemented by the mega carrier driver mill company’s to keep drivers moving. It needs to go away. That rule has absolutely nothing to do with safety and everything to do with daily revenue.

Old dominion knew this was coming just like everyone else and should have been prepared, the carrier I work for uses peoplenet and while I don’t think it’s a great system everyone else using it isn’t asking for waivers, If you use the reason they are every large company should be asking for waivers
There are more trucking companies that can take the place of OD. OD will not impact this industry if it were shutdown. They are full of scrap.

I work for a small to medium sized trucking company that uses PeopleNet and we have been on ELD’s for a couple of years now. It sounds like Old Dominion might be using PeopleNet as a scapegoat.
someone is making a lot of money on this and it sure isn’t the trucking companies or the distributors. The consumer will end up footing the bill in the long run.
Read what Old D said, the problem was NEW software and getting the bugs worked out of the system. Second, why do you even care about it? What does it have to do with you? Absolutely nothing!! Worry about your business! This law came down to drivers and
Companies that would not run legal!! Old D and the rest of Big LTL companies have always ran legal and when I was still driving for Con-Way Freight I would always be told by law enforcement that they are never worried about companies like Con-Way or FedEx or UPS, because we ran legal and are rigs were well maintained and they would just leave us alone! So take a look at why this law came into place!
That’s why I see them lying in the median or being cutoff by these safe drivers. Right. Dock bumpers. Elds suck for delivery drivers. But I will adapt and so will everyone else. Besides a lot of small companies I run with aren’t truly following the rules so let’s see how enforcement keeps up.
This is interesting as well as being predictable. I’m sure that OD has come to the realization they’re going to have to increase the number of power units and drivers,considerably, to provide the same service to its customers that they are now. As a result of e-logs, drivers no longer have the option of burying the unforeseen delays that occur daily that alter load plans and routing simply by making the delays disappear with a little creativity with a pen and a log book. Drivers will refuse to voluntarily e-log themselves up an hours of service violation and simply abandon scheduled deliveries and pick ups they would have otherwise conducted using paper logs.
If they are running on aobrd software they have a 2 year grandfather period. Plus the aobrd system is very similar to eld. i think OD just dont want to spend the money.
They need to just scrap the ELD law.All you fairly new drivers came into trucking when alot of the big companies already had ELD,s.You have no clue that running a paper log is much easier than ELD,s and you can get more accomplished in a day and be racing the clock.And for those who will come back with you run to hard or over the hours and get sleepy.Thats total bull.I have been trucking 36yrs. And I go to bed every night before midnight and get my 7 or 8 hrs.of sleep and get up and rock and roll again.My first week with E logs and lost 2000.00 in revenue.I can see loads being late on a consistent basis.There will be other issues and it’s only going to get worse.
I’m a driver for a relative smaller size company. We have been using ELD’s for around 10 years now. They do take getting used to and occasionally go haywire. There is no excuse for old dominion with that large of a company, and I think better planning in the beginning would have had them ready to go!!
Anybody who agrees with the ELD mandate is not a true owner-operator in any sense. There’s no way an owner operator would ever agree to these type of regulations. If you’re not a true owner-operator you don’t realize the hardships and you need to keep your mouth shut. You can’t speak for a true American owner-operator.
A few of the comments imply the carrier was fully knowledgeable aND prepared to make the change over. So that in hand is no excuse for not complying, yet the small 20, 50 truck carriers changed over immediately. So one commented this carrier tried to drag it out in hopes to get it over turned. If one carrier stood up and faugh that fight and won what would you say then? Yes you’d be pissed as you wasted that money, but since the move for the change is still in effect everyone is pointed fingers at them. As for a small 20 – 50 truck carrier con paring the time and money lost isn’t obviously the same. For those that know for sure why the carrier is stalling should tell their source.
We use PeopleNet and I’ve never had a problem with it. It’s not rocket science. Sounds like they just didn’t want to spend the money and we’re holding on til the very end in the hopes that the ELD mandate would get reversed.
DON T WAIT TILL THE LAST MINUTE TO START. These giant carriers preach planning. When it comes to them, not so much.
Its a logistical nightmare with shippers and receivers burning up the clock. (Not to mention traffic,construction, accidents, breakdowns, etc.) Service failures will be the norm. The big companies will lose revenue and the industry will lose drivers because you can’t make money if the wheels aren’t rolling.
OD and it’s software provider had plenty of warning to make their two systems work together before the deadline. I’d change software companies. But that would cost money. Better to bribe a politician. But I don’t blame them. ELD law is a joke. It’s like watching a bomb ticking down and you are racing against it.
If any waiver of any kind is granted to one company for any reason (excuse, actually), the law needs to be repealed since it is not being uniformly applied across the entire class involved. This goes for every law and every class involved. Any waiver is simply an admission by the government that the law is flawed and poorly thought out, if thought was ever involved.
I’ve been driving for 9 years. When I started in May of 2009 we had Qualcomm in the truck. The ELD was operational, and we were told to use it, but for educational purposes. We ran paper with it for a while. It wasn’t too hard to get used to. I think the ELD thing is nothing more than making companies pay for technology and services so the government can tax it. Or fine you if they catch you in violation. Just wanted to let everyone know. I’m not a fan of ELDs.
Second company went to Peoplenet maybe a month after I got there. Probably October of 2010. Peoplenet was a little different but was similar enough.
3rd and 4th companies ran paper for the 2 years I worked there. But now both run ELDs.
I’ve been working for my 5th company for 5 years. We’re small. Only 20 trucks. We’ve got tablets running some app. Literally took a few hours to figure it out after an hour long class.
They have been talking about this, since the day I started driving back in May of 2009.
The hos has stayed the same with the exception of some idiot who doesn’t drive a truck tinkering with the 34 hour reset and the 30 min break. Theres good intention with the tinkering of the 34, but it didn’t work. The 30 min break isnt really an issue.
Here are the real problems you otr guys face.
Shippers and receivers suck.
The HOS would probably be better if it was the old 10 hour clock.
You aren’t paid hourly.
Times are changing. I suggest those with at least 2 years experience find a local job or a linehaul job that best suits your sleep schedule. Move on, make more money and be home daily and have your weekends free.
I absolutely loved my 1st year of driving. Visiting a new state, new city daily, basically getting paid to travel. Couldn’t beat it. I understand it’s a lifestyle. But you can treat your lifestyle like a book. Some chapters are longer than others, but sooner or later you get to a new chapter.
Autonomous trucks arent going to take your job. Tesla trucks aren’t going to replace diesel power. Life is going to go on.
Start adapting and changing and you’ll find yourself in my position. I’m laying in bed after working 120 hours in the last 2 weeks. Reading your comments wondering how long you guys are going to complain to each other before you figure out a decent local company has a truck that could use a driver like you to get the job done. Probably for more money to start, for less hours and more free time and less stress.
But you’re hanging on to a dream or a lifestyle that isn’t hanging on to you.
Time to face the facts. At this point in driving evolution, driving otr for a mega carrier, is nothing more than working at McDonald’s. You’ve got flipping burgers down. It’s time to move on and go somewhere that’s better.
Oh and in case anyone wants to call me a steering wheel holder, I had over 500,000 safe miles in the first 4 years, in all 48 states. I’ve been over every mountain range in this country through all 4 seasons. I spent the first year of my driving career on the road for months at a time, barely ever coming home. I’m a truck driver, I’ve earned the title.
Now, I’m the yard guy at a local company 10 minutes from the house and just punch a clock. I just do what needs done, including sit in the passenger seat with a guy out of truck driving school last week, teaching him what truck driving school didn’t.
Time to move on guys and gals. Find something local and hourly and turn to the next chapter in your life.

It’s all about money, it talks and y’all know what walks. They’ll end up paying a fine and getting their trucks turned down and reducing they pay per mile for the drivers instead of reducing pay for the higher ups, mark my word. Sure the ELDs are safer in regards to making drivers only drive 11 hour’s, but their driver’s are some of the most UnSafe out there, so having them installed or not, their drivers are still unsafe. Instead of putting all these regulations on big and small companies, they need to start with Educating the so called Public they are so worried about. If they make it where every Class B, and C license holder had at minimum a 2hr course on what rigs can and cannot do, and teach better safety to ALL drivers, then maybe , just maybe there would be NO NEED for all the crying about installing these ELDs… Until we ALL , big n little take a stand, and I mean a STAND STILL for at least a week to show EVERYBODY how much they depend on truckers, nothing is going to change!
