While the Federal Motor Carrier Safety Administration has declared the ELD rollout a success, some carriers, lobbyists, and whole segments of the industry are still fighting back. Now, one state is asking the FMCSA to reconsider the mandate, and another is looking for ways around enforcing it.
In South Dakota, the state legislature passed a resolution officially “encouraging” the FMCSA and the U.S. Congress to overturn the ELD rules. The bill, co-sponsored by 34 of the 35 state senators and 28 of the 70 state representatives (and passed through both houses), lists a few of the more common complaints with the mandate. Complaints include “unintended consequences,” “undue financial and administrative burden,” “a decrease in driving hours,” “an invasion of privacy,” and “a negative effect to the national economy.”
The resolution requests to repeal the mandate entirely – not just for South Dakota drivers.
Meanwhile, a bill has been introduced in the Tennessee legislature that also looks to undercut the ELD mandate, but in a somewhat less conventional way.
Instead of repealing the mandate, Rep. Dale Carr has introduced a bill that would render it toothless instead. His bill would prohibit any state funds from being spent on implementing or enforcing ELD regulations.
Once Tennessee stops spending state money, they’ll forfeit the federal money allotted to them for ELD enforcement as well. If passed, this bill will effectively mean that while you’re still legally required to maintain and operate an ELD, law enforcement officers could be prevented from doing anything about those who fail to comply.

A decrease in driving hours? SERIOUSLY, paper or elog the rules are 11 hours driving in 14 hours after going on duty. If they are saying decreased driving time, then they are proving my point that people are admitting to running with falsified logs.

No it means that the 14 hour rule is cutting back driving time. Delays loading and unloading now really do affect time available to drive. No one wants to drive more than 11 hours a day but losing 5 or 6 hours in a day to loading/unloading means you’ve effectively reduced driving time by 20 to 30%.

You’re exactly right Big Red. After a 10 hr. break I drove 71 miles to the customer. Spent 7 hrs. at their dock and drove 110 miles to The Blue Beacon in Ft. Pierce Fl. to have the trailer washed out. I ran out of hrs. waiting in line. So 181 miles and I’m done for the day. It only took 38 minutes to load but 7 hrs. to unload. This why we’ll never be paid by the hr.

The problem is not the 14 hour clock it is drivers who have been running illegal all these years covering for slow customers so the customer knew they could get away with it. When I owned my own truck I would tell them that anything over 2 hours would be added on to the time when I would get the load there. If it took 4 hours to load then I told the receiver that the load would be there 2 hours later. Telling the shipper that had me loaded and on the way faster. OOIDA is finally taking up the fight they should have taken up long ago; flexibility in the 14 hour clock. But I think their approach is wrong. There needs to even more than what they are asking for. If a driver sits 6 hours and was not required to be on the dock then they should be able to extend their 14 by 6 hours. And, hopefully the driver would take a nap during those 6 hours So running later would not result in fatigue.

Those 6 hours consist of sitting at staging WAITING for the call to go to your door which is the same time 10 other trucks got called, you spend an hour trying to get thrue the front gate with the trucks, another 30 mins while swift tries to back in, get in door, dolly down, pull up go check in at office behind 12 drivers being seen by 1 person then go back and lay down for an hour, phone call to go get paperwork behind another group of drivers , go back hook up and head to gate waiting again just to get out. YES this is a really bad stop example but it’s still a variation of almost every stop I do. There is NO nap in that 6 hours.

Exactly. Once this week my driver was sitting to be loaded or unloaded 2hrs and unloaded 3 hrs. Not to mention he had a 2 he deadhead to get there. Once at the receiver from 1-4..pm..They couldn’t get him unloaded because it would take 1 hour and he needed 1.5 hrs to find a truck stop to shutdown for his 10 hrs!!!!. So the on duty not driving got ate up, plus 2 hrs of his drive time got ate up. So he had to deliver the next day. After being up 2:30AM-4:00pm (But 7 of those hours he wasn’t driving but sitting)
The ELD doesn’t factor traffic, issues at the shipper or receiver.
I live in NC there isn’t adequate trucks stops for the 10 hour break. On Saturday I saw 9 trucks on the side of the on ramp!! They don’t have a choice. This Drive time needs to be re-evaluated.

Law infor cement is not going to allow me to pull over on the shoulder of the freeway and sleep for 10 hr because my eld said no more drive time. The only reason OOIDA and others are pushing back is they want to protect the renegade truckers who brag about driving from the east coast to the west in 2.5 to 3 days. The problem m is the ones griping the loudest do not even know what they are talking about. I ran elogs for about half my career. The old fashioned ones were not as good as the elogs of today bff because they still did 15 minute blocks whether or not it took 15 minutes. With today’s elogs doing minute to minute logging you actually have MORE time to drive each day because the 14 is not eaten up by things like logging 15 minutes for fuel when it actually took 6 minutes from fuel card swipe to hanging up the nozzles. And if it took 2 hours and 8 minutes at a customer that is all that would be logged not 2 hours and 15 minutes. Of course those griping the most about elogs will not understand that because they log however little they hope to get away with doing things like that so they have “more” time to drive.

you are 100% right, i have been around this crap since 1977 and even with the eld’s we could make this work if they would do away with the 14 hr rule, this has added so much stress to our industry, constantly fighting and running against the clock all day every day, turning down loads that would prohibit getting home on the weekend, driver;s that do get home most of the time has not got much home time and no time for a 34 hr restart. I have drivers loading on a thrs, that could have delivered on friday, but choose to deliver on monday, so they can get the 34 hr restart and have some day’s with there family , that in itself cost the driver- the company and the economy ,,,, do away with eld’s they are not safe, or do away with the 14 hr rule to elimanate some of the stress it puts on an already stressful industry.

Since the mandate rolled out I’ve never seen so many trucks lining the sides of the interstates. Said this would make the highways more dangerous and it would seem I was right. Last week on 75 south a driver forced to put down on the side of the interstate was struck by a car probably looking at a phone. They had to block off all but one lane. This Obama era law is terrible and needs to allow more driver flexibility

If they would put greater flexibility in the 14 hour clock, if a driver got tired and needed a nap he would pull off and take a nap if he knew his 14 would be extended. People know when they are tired, we should be able to drive our eleven hours whenever we want in a 24 hour period. Even if they are back to back. We know our bodies limits. Since eld mandate I have driven tired for the first time due to the 14 hour clock, no longer can I stop for a cat nap or break.

I agree BF. The other day because of weather and location that didn’t have enough truck parking, I had to speed in rain and fog for 350 miles to get to an area where there was parking. All that on less than 2 hours of sleep in order to make deliveries on time. I would normally have taken a 2 hour nap and been good but didn’t even have time to stop and go to the bathroom or to eat. I arrived at a truck stop with 8 minutes to spare. I don’t like driving tired and never speed, so it was uncomfortable for me big time. The electronic logs are going to hurt people.

The 30 minute break has created havoc at all fuel stations. Small stations are losing money because drivers see the fuel island full of trucks and drive by. Frankly, the drivers are simply lazy and take advantage of sitting at island. I just want fuel!!! Ive found I won’t go to Pilot anymore because of it. I’m sick of having these idiot drivers leave trucks in fuel islands and go take shower or sit in restaurants to eat. I don’t take my break at a fuel island I have respect for my other drivers on the road.

The 30 minute break must go. Sitting somewhere for 30 minutes actually adds to the possibility of fatigue and forces a day to be extended 30 minutes past what a driver could normally do. In addition, ELD’s should be a choice, not a mandate. Freedom of choice should not be taken away from the hard working people who hit the highways everyday. CDL holders are held to a higher standard by law enforcement and government entities because they are deemed professionals. So treat them like professionals and let them do their jobs without all the oversight.

One of the biggest problems with the 14 hrs rules is parking at night. I’ve always planned my trip before I even do pre-trip so I somewhat have an idea where my day will end. Depending on when my day starts, and even when everything goes well, if it’s later than 7pm when I get to the truck stop there’s no parking available because everyone is forced to park. However because I’m out of hours I’m forced to make a parking spot for 10 hrs even if it’s not a safe spot. I don’t know if anyone on here would agree with me but it wasn’t this way before the ELD mandate. So which is safe? Just my 2 cents speaking from experience.

Waaaay back when, I designed (but never built) a thing that worked like this…
It would be mounted in a highly visible place, say on the driver’s door.
It would have a timer in it, and if the device detected that the truck had sat still for 8+ hours, the device would turn green with LED lights.
If the truck moved down the road for more than 10 hours, the device would turn bright yellow with LED LIGHTS. This amount of time would be cumulative…if the truck stopped and started, the moving time would add up.
If the truck moved down the road for 11 hours or more, the device would turn bright red.
However, once the truck had stopped for 8 hours, the internal clock of the device would reset and the device would turn green again.
The device would also have a timer that started at the time first movement was detected. 16 hours after first movement, regardless of driving time, it would turn red.
The device would be solar powered, and the device would not have any outer controls. The only way to adjust or change the sevice would be through a computerized link.
I figured this toy could be mass produced for the price of a small radio. It could be adopted voluntarily, and advertised to the public AND law enforcement as a highly visible indicator that “this driver is rested”…
It would serve to make sure that the driver rested 8 hours a day, regardless of whether he was being pushed by dispatch, and it would give the driver a lot more freedom during the day to work and fuel and do the 1001 other things a driver must do.
I sent it to FMCSA and they basically told me that it was a good idea, but it didn’t limit the number of miles a driver could drive, which was their goal.
I gave up, but I still wonder of maybe NOW isn’t the perfect time for my toy…

If your actual driving time is over 50 hrs per week, and you still feel you need to cook your books, or bitch about easing regulations to allow more driving hrs…you need another career.
Blame your personal circumstances and life choices. Not the game.
I driven 26 yrs for 3 companys. My philosophy has always been the least amount of hrs, for the most amount of money. If you live by that rule, and live within your means, you aren’t beholden to the need of driving illegally, unsafe, or whatever.

Ya give flexibility to the 14 so shippers and receivers can get worse and we can give away more of our time. Let this ELD rule and current HOS stand and let rates continue to rise I’m really loving it.

They can fix the hours of service by putting the old rules back in place. No more than 11 hours of driving or 14 hours total on duty our in 24 consecutive hours! The quick way is all company drivers be paid hourly wages instead of by the mile. Watch how the companies jump in and make their drivers a priority instead of using them to get work done for free!!!

YES YOU CAN LIE ON ELOG (somewhat):
NEVER go off duty or on duty (except long enough to look real)… ALWAYS go to Sleeper Birth.
If you are somewhere long enough you can just stay longer for a full shift reset
BUT
If you ask your company administrator to change it later two problems arise: 1. That person might be a devout Christian and unwilling to lie or they might be a devout Muslim so screw you for asking Infidel or 2. If they make the changes there is a perminant record of the edits and after a crash there’s an audit of your last 6 months logs and the audit will show that you cheated constantly.
There’s another problem too: How many drivers are asking the admin for changes? Too many, that’s how many. So making changes will become an argument that you’ll frequently lose to teach you to stop asking.
The bottom line is this: Prevent situations where you have to edit by sleeping as often and for as long as possible ALL DAY LONG… EVERY TIME YOU APPLY THE BRAKES… Exadurate it massively and purposely sleep longer to force shift resets.

Hello gentleman,is anyone familiar with this?: recently i install the eld in a 2005 glider with a1999 cummins engine and everytime a turn off the truck and start it back a malfuction shows on the eld ( says eld malfuction go back to paper logs, and the other code says engine sinc faliure) i contacted the eld company and they said the fmcsa make the rule going by the vin # , but seems like the engine is rejecting it, so can sombody tell me a way of getting a waiver from the fmcsa?

The ELD bs is why after 20 yrs of driving I got out. I was more stressed after 1 month of ELD driving than I was the whole first year I drove. I was more tired because I couldn’t flex my schedule to fit freight needs. I know I became a less safe driver rather than more safe because I was always eyes on the clock and push push push. I got into trucking because back then you could write your own ticket now a computer gets to write it for you. Good luck out there brothers and sisters and watch your back door.

There’s a saying “you hate trucking. Then stop buy stuff.. problem solved” America needs trucks to move your products and not all truckers are bad. Nor do all truckers need to be told when to stop driving. Let them make the choice when and where it is safe to stop not the clock.

Listen guys the bottom line is until all of us get together and stop for one week then turn it into two they’re never going to listen think about all the money and feel that we’re going to save in this country diesel prices will go down they would understand better about the loads the price of milk will go Sky High and you will make all your money back by taking off A week or two , until we all decide to stop it’s never going to change please guys get together with all the rest of the truck drivers and just stop no work for a week second week we can shut the whole country down . They will drop the ELD system like pancakes .

You want to use the Eld use it correctly. all you guys go to your shipper and receiver and go off duty that’s not what it was meant to do. then we will see how much you like your eld’s. we told Little White Lies in our paper logs and yet you want to lie on your Eld. What a bunch of crap. do away with the e-logs let us go back to paper so we can run the way we want and have freedom again.

Using s 24hr. Clock have a 15 hr. Work day 1hr. Manditory break any time in the 25hr.time frame and does not count against your 15hr.day and have s mandory 8hr.break after 15hr.work day. Can drive a Max 15 with minimum 2 – 1/2 breaks. Problem solved.

Wow I read some of this and it so funny one guy says you cheat the other says you must be a company driver. Okay here is my take on this and feel free to let me have it. The ELD thing doesn’t work for me. Let me say that again it doesn’t work for me. I don’t want to drive more than 11 hours in a day but I do want to start and stop when I want to. Seriously who wants to sit for 10 hours even 8 hours. The big company’s I see why they have the ELDs in there trucks so they can keep up with there drivers and there hours. I mean some of these guys can even drive much less manage to write in a log book. Leave it like it was it worked for me because I could do what I wanted to. The paper is safer I’m sorry. I can’t tell you how many times I have passed company trucks on the interstate where the speed limit is 70 only to get to a construction zone and be passed by one of those guys because there on the clock. Okay I’m rambling but the whole eld thing just doesn’t work I will have to work more hours to get the same money which willl keep me away from friends and family you tell me if that works? And one last thing for all you guys saying people on people cheat there logs. You could say that but it’s more like I make it look like I want to for my advantage. If your fat and lazy and have no ambition then I’m sure the eld works great for you. I’m sorry we’re not all created equal it’s just a fact and I should have to conform to someone who’s not as motivated as I am.

That law is only good for local truckers. Everybody else will still show up late because after they leave the state, any DOT in other states will bust them for log book violations.
