Speaking in Washington, D.C. this past week, FMCSA Deputy Administrator Cathy Gautreaux reflected on the last year and spoke about the agency’s priorities moving forward.
Gautreaux was the keynote speaker at the FMCSA Analysis, Research, and Technology Forum at the annual meeting of the Transportation Research Board. In her speech, she praised the FMCSA for its successes, calling 2017 “a good year for us.”
As proof, she noted the rise in the use of safety belts by truck and bus drivers – up from 65% in 2007 to 86% in 2016. And despite reports of lackluster compliance rates, lawsuits, exemption requests, and multiple pieces of legislation seeking to dismantle or postpone the ELD mandate, Gautreaux also claimed “the rollout of the ELD rule was a success.”
Indeed, according to Gautreaux, the FMCSA will stand firm on all safety-related regulations. But the agency will make it a priority to ease regulations where they can – especially when it comes to technology.
“Technology is the next frontier,” she said. “We are on the cusp of revolutionary changes in the way we move both people and freight, and I am excited for what the future holds. That’s why I am looking forward to the several projects we are working on that are related to driver-assisted technologies. I expect the work on these projects to move forward this year and in 2019.”
While Gautreaux has only served as the FMCSA’s number two since November, she seems to have a clear idea of the agency’s agenda moving forward – deregulation for private sector investment and new technologies, but a hard line on maintaining what the agency views as safety regulations.
“21st century transportation technology [is] a bright part of our future that will make us the envy of the world,” Gautreaux concluded. “Working together in partnership with our public and private sector partners to do so as safely as possible is paramount to our mission. We all have roles to play to make this vision a reality. I look forward to working with our partners as we advance these goals and priorities.”

Yes, like putting a guy with 6-8 months experience (a trainer?) in a truck with a guy whose driven 6-8 Days TOTAL & claiming that makes for adequate training, while doing everything they can to force the real drivers like you out of the business.

I don’t usually say anything, but Phil A your view of cmv drivers is grossly wrong. First, how does an eobr stop any driver? It doesn’t unless the driver is a law abiding citizen who wishes to comply with regulations. Second, how does any elog stop any driver from taking ” little white pills to stay awake” ? It doesn’t. Any motor vehicle is a killing machine regardless of its weight if driven incorrectly or driven by someone under the influence. I have used both eobrs and paper logs and I can say they both can push HIGHLY unsafe driving practices. What’s the difference in a driver backing up his book to drive and a driver who has had 10 hours off during the day at a shipper where he cannot get any useful rest going on duty being allowed 11 hours to drive? Absolutely no difference they are both hazardous. The difference would be the mindset of the driver. If safety is truely the goal then the first thing the new regulations should have addressed is how new drivers are trained. Let me put it this way, it’s a beautiful analogy. Would you go to a surgeon who only attended 6 weeks of medical school and who has only been in practice 1 week? That is the training time of a new driver. Big business trucking treats this as a “CDL mill”. Train, drive, wreck, fire, new hire. They will send a newly trained driver into highly dangerous driving areas and conditions where the driver is at risk from the moment he is dispatched without remorse or fear that the driver is unprepared to safely drive. Treating drivers as a byproduct of the freight and trucking industry has caused the majority of safety issues, hence that’s why right now we have cmv drivers who can’t even speak, read, and fluently understand English.

Phil, I’m 71 years old got my cdl in 1963 at the age of 17, I believe that’s about 54 years & still an O/O today, just a tad over 6 million miles 100% safe driving record thanks to God. I believe the key to safety is GOD , Not a one world order global tracking & recording device, it won’t change safety at all neither can you educate Stupid!

Not sure how you time traveled and got one in 1963??Before the CDL we had a chaufers license when I started in 1980 NO testing required just $4.00 fee.
I got a “commercial drivers license” in 1985. It wasn’t the federal one that we have today, it was a state issued license. Never had a chauffeurs license.

Let me refresh your memory, In the state of Oklahoma 1963 I applied for and got restricted school bus operators chauffer’s license, which fulfilled the state requirements as an operator’s license, and also allowed me to operate a larger than personal vehicle for hire, within the boundaries of our local school district. I drove on that license until I turned 18, Tested and passed for my Commercial chauffer’s. and you are right, I to got tired of trying to explain all of that after 91, When the CDL came along, I was grandfathered in just had to go pay them the extra money, and get a different back ground picture+
Give us a break, in car truck accidents the car is at fault 90% of the time. 10-30 time an hr I get passed by car drivers with phone in hand.
ELD’s are unsafe, drivers are racing the clock all day and stressed out , if truth be told . They make mistakes so you still have to run a paper log if it goes down. What about local , under 100 air mile drivers? They’ll still run as many hours as possible with a time sheet. It’s really not fair or equitable .
Some of the worst , unnecessary accidents I’ve ever seen were by newbie mega fleet drivers who have been on e logs forever. I worked for Sysco in 1994 and they adopted e logs
Trying to cut overtime , and harass drivers. Guess what ? They’re turnover which was already high due to the galley slave nature of the job doubled, and many including myself left.

Alot of fleet owner/Owner Op/also Driver requested us to unlock their speed limit to catch the maximum milage due ELD timing, I assume any other garage out there have the same amount increased of this request lik us, YES it really dangerous but not the truck speed limit, it because of the ELD.

Yes, because forcing people to work when they are tired, not allowing them to take an afternoon nap, or racing though cities and towns and hurrying to get their work done before they run out of hours is safe. When they started enforcing log books here in Canada in the late 80’s the accident rate went…..up, because they forced people to drive when they were tired. There’s nothing like sitting there, wide awake for, four, five, maybe six hours waiting for your log book to tell you that you’re safe to drive at 8-9:00pm. But yup, it says you’re safe to go trucking until 7:00 in the morning. It definitely knows better than you when your tired. Me personally would have rather went truckin at 3:00 in the afternoon until midnight-1:00am and then slept when it was dark and when your suppose to sleep. But hey, now I’ll have to push it through and hope I can drive all night without falling asleep behind the wheel. Oh ya, I forgot the log book (ELD) says that won’t happen because it knows better than I, when I’m tired. So when I have a wreck, sue the ELD, it was the one that said I was safe.

Obviously you are seriously misinformed. I’ve been trucking for 24 yrs. I don’t take little white pills. I use coffee. Most of fatal crashes involve vehicles WITH ELD’s like the Wal-Mart driver that rear ended Tracy Morgan’s limo and several other high profile cases. That little computer tells a driver he has to drive 11 hrs with only a half hour break. And believe me a majority of these trucking companies now have the tools of technology to force a driver to get behind the wheel after he slept in a truck with a broken A/C system somewhere in Arizona. Most of these trucks have idle restrictions like mine that won’t idle between 30-60 degrees. Next time you see a trucker weaving down the interstate, he will most likely have a little on the side of his truck “Driver Using Electronic Logs” By the way, if it’s good enough for a Professional Driver, maybe it should be good enough for you. RIGHT?

I have read about 4 separate incidents of drivers being under the influence of schedule 1 drugs while behind the wheel in the last 4 weeks. One of those was on meth. He got caught in Ohio then 2 weeks later? He was involved in a wreck in Kentucky where he had meth in his system AGAIN! Now tell me how in the he’ll would an ELD stop this? Elds are about productivity and control, not safety. The problem is piss poor training requirements and general crappiness of humans these days.

Well I’ve been driving 15 yrs accident free and have never had a ticket and won’t because I’m eld exempt. But since the eld mandate has been put into effect have seen nothing but more fatalities in our industry. Before you go spewing off with nonsense garbage you should check the facts and statistics Swift was cuaght altering documents that showed less accident’s than they were actually having since the implented the eld.
Not about slogs but HOS need to be more flexible instead of a straight 14 hours. Because that’s unsafe. An if you were a real driver you would know that that is true.

First the Big boys have 3 trailers for each truck, if you have just one trailer, how do u compete? Then the FMCSA came along to allow huge driver turnover, it’s not a safety law at all, it’s just a legal excuse to hold down their payroll expenses. Now that the big boys know automated is coming, it’s a full push to end the OTR driver. Tankers, flatbed, speciality will be all that’s left.

The ELD mandate has been a disaster. Those forced to use ELD’s are affecting experiencing ELD failures, incorrect logging by the equipment, unreliability issues, poor customer service and high costs. Productivity is down. Parking is a serious safety issue. Thanks to ELD’s some are being forced to run illegally, park in unsafe areas, such as along major interstates or pay high rates to park. Some truck stops are charging as much as $20/night. User’s are still required to keep paper logs in their trucks. According to the safety person at a major carrier, it takes longer to audit logs with ELD’s than paper. Since ELD’s have become more prevalent, accidents involving big trucks are up. Perhaps someone can tell me how ELD’s are good for business and make roads safer.
If technology is really the answer, then why do all the big outfits that have pushed for this crap have such horrendous safety records? Swift, Werner, England, FedEx,……the list goes on. I can’t get thru a single day without seeing one of these morons in the ditch, wrapped around a pole, high-centered on a boulder, jackknifed, or parked on somebodys hood. Yup, elogs is the answer……

They give me a door at shipper and after 3 1/2 hours got loaded with 44.998.
When I ask for time in and out the lady at window said no problem….your app it’s for 6 pm so you will get nothing from us.
I told the entire story to the lady at JB and she told me that nothing she could do about it….honest mistake.
So nothing change…,except that truckers are pushed to go to the limit unsafe like never before.

I’m so glad I’m running local with hourly and paid overtime. I’m actually making more than I was with mileage pay with less stress and a healthier life. No elogs or a nagging boss sitting at his desk watching his computer bugging the crap out of me by watching where I am all day long. It will be a cold day in hell before I ever go back out on the road!
Last night I spent 7 hours on the receiver’s dock door ” Walgreens DC” without any regards to HOS or me, by the time I was done, I had few minutes of HOS left with no place to park other than the roadside where I was awaken to be handed a parking violation, and was told to get going. Let see, reload lost, safety compromised, rules broken. All these in the midnight hours, with my own authority, a one truck, one trailer company. Great job FMCSA.
If the 4 wheelers out there would stop being stupid and have respect for the truck drivers they can’t stop on a dime and everyday they pull out in front of a semi or cut them off if they had to drive one before they received a license then maybe they would realize what can happen
Everyone focus on trying to make the trucks cheaper to make and lacking the quality that they once had. I drive an old Pete 379 that spends more time on the road than anything new in our company. Everyone focus on after something happens to the drivers already on the road. What about the trucking schools rushing their students through in a few weeks. Time and time again I have to instruct a new driver fresh or. Less than a year out of school that can’t back into a common door. Between two trucks. Let’s get real and stop worrying about big businesses and government making money and go back and enforce schools to take longer to train students and then send them to trainers on the road. Use ELDs on the new drivers that haven’t a clue what their doing. Pit respect back where it belongs. If a driver with years of experience and has a clean record, respect it and stop punishing them.

ELD is a pain in the ass. They stop nothing and still be modified. A ELD can never tell anyone how much sleep or rest a driver gets. A Driver could be up all weekend long and jump behind the wheel Monday morning with no rest. A driver could run a ELD for months and never get pulled over or caught. ELD or not at the end of the day it’s still up to the driver what happens. The Government can’t control people being killed by stronger gun laws no more then they can control Truckers with ELD’s. If ELD’s could stop anything then they should be installed on all cars to stop four wheels doing what they do. I know the supports of ELD’s are clamming a victory now, but overtime they will see that they actually lost! I will say for company drivers it will make it harder as a company drivers don’t control the program. I guess the DOT doesn’t mind reading a three page report on one day for ELD log that list you were in one town ten times for 30 minutes and truck traveled 15 miles. Have fun DOT!
The thing most drivers do not comprehend about ELD’s , when this system is fully implemented any one that you local government deems worthy can access you ELD, which has not only information about the driver but also the cargo in the trailer, info like product loading and receiving addresses, shipping labeling requirements and any other information that use to be protected by the driver, now they can access while you drive by at 70 mph.

Amen , every word is true. I’ve been saying this for some time, and did actually shut down from Dec 16th till Jan 2nd. I was hoping most will do the same, or to some extent, but, like you said, we don’t have the backbone to stand up against this BS, maybe we deserve the dam thing after all.

The safety pledge on this ruling is a joke. Most drivers are pressured to get somewhere, strangled by time constraints, then they make foolish decisions. I see it all the time, been the victim of it as well.
If all the drivers stopped right where they are just for one day & not deliver the product. Just watch how fast we can change the whole system. We all do not like the way we are controlled, so in order to change it we have to take responsibility ,get together & stand against ELDs. How many lives it will take,before they realize what a dumb mistake they have made. We are running under more pressure, more mistakes on the road. Just do not deliver the product & halt all the roads. I am preety sure if the consumers did not receive their product , no food in stores. No water in water aisle, no supplies @ the hospital. That will change the system. But none of us will do anything for the change, we will just sit on our asses & write comments. Just follow the given rules. Do what it takes to make us drivers heard, block all the roads & halt the transportation.

With the cpm you make you need every minute! I suggest you learn how to fill out a paper log cause it’s still required when your eld fails.

It was not a success! This highly lauded piece of so called technology is a one size fits all nightmare. Drivers have to drive like maniacs to make their allotted time count and it has no latitude for personal sleep cycles. All it is is Big Governments heavy handed, forced on us attempt at control and a source of revenue. Sorry, Lady this was not a success for the workforce. Maybe a success in your attempt to control drivers but that’s about it. Safe? No, it’s not

The ELD make it less SAFE due to drivers speeding trying to meet delivery times before their ELD put them out of service. It tells a driver when they have drive and they may not have had rest when they have began driving. It’s just like every corporate enitity where the person at the top making decisions for the workers who actually do the job which they have never done nor even knows what that person does. This was not thought through by those making decisions and how it was going to affect safety nor the economy! They should have went to the persons closest to the task (DRIVERS) in order to get their feedback on how this would affect them and the customer! This is not a successful rolout but a DISASTER in the making. Let’s see how safety stats look in 6 month and the number of fatal accidents increase due to drivers speeding to meet delivery times. Cause if they miss deliveries and have to layover for days to get a new appointment they are losing Revenue then you will see carriers going out of business. Some drivers due to ELD mandate have already made the decision to sale their truck and “Get Out”.!!

I wonder why nobody really see’s why ELD mandates were brought to my profession.Short and to the point,ELD’s takes liability away from company management thus reducing lawsuit amounts.Think about it.
That’s the smallest part of the whole thing. The main factor is that its designed to put smaller workforces out of business by nature of unlawful self incrimination. It records your speed thus if you are rollin down the hiway at 70 mph on cruise control and posted limit is 70 mph and you start down a hill and the law of gravity makes your truck increase to say 72 mph and you get inspected and a ticket for going 72 in a 70 its going to cost you money. It already costs you money for the ELD so you are paying for something that’s going to get you in even more trouble and that’s just the tip of the iceberg. It violates your 5th amendment rights on that point alone. Truckers cant survive under that kind of regulations for long and the anti trucking association(ATA) knows this. They keep an unlevel playing field by being “self insured” and their ability to buy the software to control the ELD thus their office can edit the records of their drivers. They can erase things that we can’t. So the more small guys that go out of business over this increases their chance for more freight. Its called monopolizing which is supposed to be illegal too. I guess its not though if you pay off enough lawmakers.

Yea well the new age trucker is lazy. They have no cbs which cause more accidents because they don’t know what’s ahead. More drivers are flying because of the eld counting down. Parking on side of the road and where ever they can just to avoid violation. Yet it was a success they say, also they want self driving trucks yea that’s just another way for drivers to be lazy until computer fails and kills ppl.
Dam government don’t have a clue about trucking.the only thing elds are going to do is cause more accidents,Drivers racing against the clock speeding to get their load to a destination,or trying to get to the next load, and not getting proper rest it seems more of a health hazard,than safety! Wrong. Now my hubby is making less because he has to stop and he’s not making it home on weekends. It’s a tough job and now you have taken away the few perks that makes it tolerable. And he has to stop where the miles run out which can be a place not safe and possibly where there is no food. Government doesn’t account for weather delays, traffic, etc to take up those hours they are allowed to drive. Mandate eight hours of sleep per day but stay the heck out of the rest. This weekend hubby was five hours away and because of running out of hours he wasn’t allowed to unload and come home. One day would have been great instead we got none. That also puts him and the company behind on loads for next week. Put actual truckers on those safety boards they know how it should be. I know there are a few bad truckers but from what I hear it’s the damn car drivers that cause quite a few of the wrecks. I’m done venting. 😒

To start with I got my chauffeurs license in 1966. I have ran paper logs and the new elds I personally don’t mind either one. Having a good dispatcher ( driver manager) makes a world of difference. Something else that has made a difference is putting into law is forcing almost all the trucks off the road at the same time. NO one thought to look at where everyone was going to park.
All over the country they have stopped truck stops from opening or enlarging. The States have put ordinances on trucks in rest areas or closed them down. They have increased fines for parking on off ramps and many other places. The dot has gotten into working the rest areas. So if you are asleep and they wake you for a check you are expected to start your time over again. It has turned into a money racket. I have even gotten a ticket for stopping to help in a truck wreck and fire. The cop would not even call for a fire truck until he finished writing my ticket. He was going to write me for not having a working fire extinguisher. But I messed him up on that because I had 5 of them.
So if you going to make new rules and regulations look at the things affected by what you are doing. Yes us truckers are pretty good at making do, but why should we be made to ” make do “. We are expected to do our job and having to fight educated idiots in government is not one of them.
The government could help greatly by letting truck stops enlarge. Making new or enlarging truck parking in rest areas. But the one thing that needs to be reworked is the 14 hour rule. If we have a long loading or unloading time allow us to log in to the sleeper and stop the 14 hour rule.
Just think if the trucks stop in 3 days panic will take charge. We can only operate the truck we drive. Educate the public about the trucks. Because a 4000 pound car is going to lose to a 80000 pound truck every time. Even the government figures say that 90+ percent of the wrecks are the fault of the car driver.

If the roll out was such a success, why did both the FMCSA and CVSA agree to not enforce out of service until April 2018, yet the mandate went into effect in December 2017. If that is success, I would hate to see how she defines failure.
If everyone would do some research, the eld rule is causing a truck shortage, which in turn is causing increased freight rates. My friend just got a 5 cent per mile raise to 50 cents per mile. Stop whining about everything. If you work for a crappy company still making 36-38 cents per mile and have a good driving record and over 6 months experience, go find a new company. The eld rule is not the end of trucking like everyone says. Just too many people willing to spend their life on the road and not get fairly compensated. I know 50 cents still isn’t where the pay needs to be, but it’s a lot better than most companies are paying. There is nothing you can do about the rules, we have seen how well drivers bond together. Just make the best of it or find a new career.
