The highway funding bill that’s making its way through Congress has a provision which would delay the implementation of the HOS reform rules by up to 18 months. Officials at the FMCSA don’t seem concerned however. They say that HOS reform isn’t subject to Congressional approval.
The House highway funding bill is facing stern resistance. Republicans have pushed back against increased infrastructure funding despite support from President Trump to both rebuild the nation’s aging roads and bridges, and to help stimulate the economy out of the current recession.
One of the provisions of the bill seeks to delay the implementation of the Hours of Service (HOS) reform rule by up to 18 months. The provision is intended to provide enough time for research to be conducted into the potential impacts of the new HOS rules.
Director of the FMCSA’s Office of Compliance and Enforcement, Joe DeLorenzo, was speaking at a webinar hosted by the National Tank Truck Carriers on Wednesday. According to FreightWaves, DeLorenzo told attendees that the FMCSA doesn’t expect the HOS rule to be postponed.
DeLorenzo says that it doesn’t matter whether or not the highway funding bill is passed in its current state or not. According to him, Congress doesn’t have the authority to delay the rollout of the rules. Establishing the regulations are “not a Congressional action, they’re within our discretion through the federal rulemaking process.”
If the rules proceed as FMCSA expects, they will go into effect on September 29th.

I saw something about changing expanding the local driving radius for the exception and something about making the 30 minute break requirement for 8 hours of driving instead of on-duty. I THINK I was looking at the right thing but I can’t be 100% sure.

If you dont know the new rules until now you have been asleep at the wheel,they have had it going on for couple years now and drivers were allowed to comment in plenty of meetings,I just wish they would go ahead and implement them now.

Here are the new regulations.
FMCSA revises the hours of service (HOS) regulations to provide greater flexibility for drivers subject to those rules without adversely affecting safety. The Agency: (1) expands the short-haul exception to 150 air-miles and allows a 14-hour work shift to take place as part of the exception; (2) expands the driving window during adverse driving conditions by up to an additional 2 hours; (3) requires a 30-minute break after 8 hours of driving time (instead of on-duty time) and allows an on-duty/not driving period to qualify as the required break; and (4) modifies the sleeper berth exception to allow a driver to meet the 10-hour minimum off-duty requirement by spending at least 7, rather than at least 8 hours of that period in the berth and a minimum off-duty period of at least 2 hours spent inside or outside of the berth, provided the two periods total at least 10 hours, and that neither qualifying period counts against the 14-hour driving window.

All the money and time wasted to implement new rules that benefit no one.. as far as the insurance increase they cry personal injury increases have not occurred in years so it’s needed to keep up with inflation, well how about drivers wages and earnings? Where’s that increase at.

Going on 40 years driving I have heard and seen many changes for truckers like me and many others I like driving a rig drivers complain about this and that I am waiting to see how much longer we as drivers are going to put up with this 20 years ago repair rates along with other stuff were a lot cheaper then if our pay went up as fast as anything else we would be making money and now some fool in the government want to double the insurance rates yust to fix roads and they think it’s going to make it safer for drivers they need to focus on shippers and receivers but you never hear anything about that do we of course not we can sit around in a truck stop for 3 or 4 dayes but oh my good we can’t go on strike because we need the money I may lose my job

DoT’s entire rulemaking authority descends from Congressional authorization to do so. If Congress passes a bill, it’s federal law, and it supersedes bureaucratic rulemaking based upon previous Congressional authorization.

The FMCSA is wrong, in regards to Congresses authority, to delay implementation of these rules. Congress has congressional oversight, over nearly every department within government. Not sure why the author of this article, would want to be disingenuous, by convincing the reader otherwise. Other than to stir up further chaos, division, and controversy, in an already troubled, and unstable time period. The Constitution clearly spells out, literally, Congress’s responsibilities, and powers. This only demonstrates to me, that it’s not necessary, to know your subject matter. To actually know the law of the land, in order to engage in writing it, or writing about it. That apparently, you can just make it up, as you go!

The issue is that Congress made a law about the process by which to make rules, and the FMCSA followed that process, and now a few people in Congress are trying to tell them to NOT follow the rules that Congress itself ordered, and it just doesn’t work that way.
Congress has to follow their own rules as well, unless they want to go back and also change the original rules.
The rule change has already been made, and it’s already been published as Law, with a short delay to allow people to implement it, and now Congress wants to try to short circuit it’s own laws and procedures, and try to undo what was done properly.
Basically, Congress made one rule, and now this ammendment is contradicting their previous rule, so which one wins? The minor ammendment or the major law that defines how our government works?
So, it would end up in court, and the court would have to decide which of Congress’s laws were enforceable, and which were contradictory.
And hopefully the rule making process is the one that comes out on top, otherwise the entire system of agency rule making is tossed out, and the federal agencies are unable to function anymore (including the ones that pay for road repairs, farm subsidies, law enforcement, military, etc etc.)

The bill changes nothing unless it’s signed into law. Without going into detail, Congress does not make regulations. The law spells out what Congress wants and the agency writes the regulation that we abide by.
