Even though the strike at the Port of Vancouver has been over for a few weeks, the legal battle rages on. Thirty-three Canadian carriers have filed a lawsuit against Canadian authorities alleging that the federal rate increases that were implemented in order to end the strike were unconstitutional.
The carriers were not a part of the negotiations when union and non-union truckers sat down to talk with representatives from the Port of Vancouver and both the federal and provincial governments. Because of this, the carriers are claiming that the government didn’t have the right to impose increases on driver pay and fuel surcharges, set hourly wage benchmarks, or compensate truckers for waiting time.
A spokesman for Unifor, the company that represented the unionized truckers during the negotiations, has stated that he’s confident that the Canadian government will stay the course and impose the waiting fees.
“Both levels of government have assured us that we are pressing forward to implement the plan,” he said in an interview with the Vancouver Sun. “So we are happy with that assurance.”
The spokesman went on to say that he was disappointed that the companies are challenging the resolution.
“This is just a legal maneuver that the terminal operators and the trucking companies are using to get out of accountability,” he said on Thursday.

I the drivers are on duty waiting to perform for these companies, the why on earth would they pay them? I am willing to bet that none of the executives for these trucking companies would expect to donate their time at work for “FREE” !!!
If a person is performing a service for you, the PAY THEM!
Evidently I have fat fingers this morning. Correction to above…
I the drivers are on duty waiting to perform for these companies, then why on earth wouldn’t they pay them?
🙂
It would be nice if American drivers would organize a strike.
That’s great for the drivers at the Vancouver port!!!
If companies claim they won’t be able to afford paying wait times and increased wages
then the companies need to increase their rates to the shippers!!!!
Plain and simple!! Why do drivers have to be the ones that always get screwed out of wages!!
I only wish ALL port / inter-modal drivers across the United States would unite and demand
Increased wages!!
The trucking companies did not come to the table and wanted the drivers ordered back to work but did not understand that if you order them to work you must pay them fairly
