New Prime, Inc. has filed a lawsuit against Amazon, alleging that Amazon’s service known as Amazon Prime infringes on their trademark. According to Prime, Inc, Amazon is “tarnishing” the company’s good name and reputation.
According to Prime’s lawyers, Amazon’s use of the word “prime” on their trailers and vehicles is “degrading Prime Inc.’s reputation and goodwill.”
Amazon filed a brief on September 2nd which denied Prime’s allegations and refused to suspend use of the word or pay any damages.
Prime claims that Amazon “has and continues to use confusingly similar marks in connection with the transportation of goods via trailer trucks and other shipping and transportation vehicles in commerce.”
Though Prime appears concerned about ongoing damage being done to its brand and reputation, the court appears to be in no rush to remedy the situation. A trial date has just been set for February 7th, 2022.
The two companies have until February 3rd, 2022 to reach a settlement.

Prime isn’t even a bad company. You all just parrot the same crap everybody else has been because they’re a mega carrier.
I'm_me says
I leased a truck through prime. They’re the worst scammers out there with their shitty truck lease scam. They push all of their newly licensed drivers in to leases.
Deborah says
I agree with you totally. I used to work for Prime as a lease driver from the door. At the end of the lease Pr8me gives the driver bt 15 and 20k. They want you to put it as a down payment for another lease to own but you dont have to you just bounce and go buy yourvown truck.
Ray says
I worked for prime about 15 yrs ago. They were a crap company then and they are a crap company now
Jillie says
You ever work for them??? 🤣😂🤣😂🤣😂🤣😂 Or could it be that you work in one of the offices?

James says
You don’t even have a clue, as an independent operator I have lost a lot of contracts due Prime inc coming in behind me and cutting the rate down just too steal a real honest hard working mans/woman’s job… I’m talking instants 10 years ago 1 of my customers 2.55 a mile Prime inc comes in and takes it all for a 1.19…do the math, Prime is for themselves not the drivers, they just make the payments on the trucks for the company
Jaebro says
What planet have you just landed from driver ?
I can go back to 1985, same method of operation lease purchase which is nothing but a ripoff in a double payment system.
Not smart thinking when you pay to lease then pay to buy the same truck.
If there was a challenge from Prime on Amazon’s, use in there name, it should have been at the beginning, not years down the road.
Court date February 2022,
That tells you how much of a waste of time & taxpayers money this is.
John says
@Jaebro Yeah I never understood that either. It’s why I’m not an owner operator. I’m not going to continue to indefinitely finance a truck that I’ll never outright own. It’s almost impossible to outright buy the trucks also because most of these carriers will refuse to sign you on if the truck is more than two or three years old. So it forces you into a never ending lease with payments of $3,000 a month or more. I don’t know how anyone can make any money in that situation. All it takes is one or two bad weeks and the trucks getting repoed. Only way to do it is to get your own authority, buy day cabs and run local. Most day cabs you can get used for around $20k. With the standard 20 percent down payment, it puts the loan at $15k which would put the monthly payments under $400. Also fix as much of the truck your self as you legally can because independent repair shops will bankrupt you in a hurry. They’re not anymore complicated than fixing a car. The parts are just bigger. It’s the only way I’d do it.
John says
so they wouldn’t hire you
Harley says
Diddo!!
Don says
Amazon’s response will be to have a better fleet of drones than “Prime Inc.”
Elmer fudd says
They smelled some more free money in bezos’ pocket. Sorry if any of you drivers are we tall did enough to work there.

LOL! I never heard a good thing mentioned about Prime INC. Amazon Prime is a piece of crap! I live in NY, there’s two Amazon fulfillment centers near me. Before Amazon’s “Prime,” I’ve ordered stuff with free shipping, and got it the next day. Then they thought up the Prime scam. Why would I pay a membership fee for something I already get for free. Now when I order something from Amazon with free shipping, they hold it for five days. I get it one or two days after they ship. So they hold my items to give me incentive to pay their membership fee!!!
So now there’s two Prime companies I stay away from!
Tommy Molnar says
Believe it or not, just last week my wife ordered something from Amazon in the morning – AND IT SHOWED UP THAT NIGHT!
John wharton says
It is a scam operation 100%,I’ve done the prime suicide lease
J. Filo says

Earl B Putnal says
Prime Inc out of Springfield Missouri. Is a tarnish on the transportation industry as a reputable company as it is. Commercial jealousy on their part. Is a redundancy. Much less a influence to commercial commerce. Rob Lowe is going to resemble a foolish portrayal on themselves. And I hope Jeff Bale’s lawyers wipe the courtroom floor with their nuisance accusations.

Jack of all trades says
The funny. I never knew that prime inc outta Missouri had a good name.. Ever…. I’ve been driving a few day’s now, and there is no way anybody with even a small portion of a brain will confuse the company’s. What a joke. Lawsuit is just to bail out there own financial deficiencies. Lmao
Lance says
You would be surprised with some of the places they order and deliver from

Amazon prime is quickly taking over swifts reputation.I see Amazon prime trailers in some kind of accident almost daily. I think PRIME has a good point.
Steve says
Prime is looking for a way to get free money Other scam by prime. They will never have a good reputation. They like to steal from the drivers
Robert says
When I work there, all I heard was negative paychecks from their leasing program.
Bill says
If you had negative paychecks then you were not a good driver and doing it right. I’ve been there 10 years I’ve averaged 100 K the past five. You just don’t know how to manage your business.
Dougie Google says
Prime Inc should pray someone would dig their crappy name out of the gutter to make them look better. Their truck lease program made it so drivers could really never go home or they would already be in the hole and losing money before they came back out. I sat through their orientation about 25 years ago, then got up and walked out because they tell you that you’re buying the truck, but yet they get the depreciation write off, and if you leave they keep your maintenance fund. Nothing but a bunch of damn crooked bastards. Jeff Bezos has lawyers that will wipe and wax the floor with Prime Crime.
Bill says
25 years ago he went through orientation? Things have changed.

Xz says
Why?
Adam R Adair says
The issue is accident rates and being mistakenly in lawsuits by crash victims as Amazon. Its more of an outside trucking industry and customers opinions on how reliable Prime is on contracts.
The company has spent real money on having to prove in court that the truck doing 85 MPH that cut people off was not Prime inc. AKA New Prime inc. They are governed at 65 lease/owner op, 62 company with jake auto engage at 67 under cruise.
MrYowler says
Prime Inc trailers are pulled by contractors, same as Amazon Prime. If Prime thinks that their reputation is Amazon’s fault, they should also sue every contractor that ever pulled one of their trailers.
Somewhere, there is a Prime lawyer drooling over that idea…
Bill says
You are incorrect. Contractors yes but not hundreds and hundreds of individual companies like Amazon prime is. There’s a big difference.
Andrew H says
I never made the connection. Only thing I know of Prime the company, is either drivers who do 54mph always, or has lease drivers who drive like a bat out of hell. Nothing in the middle.
MGE Dawn says
This. 100% this.
Orlando Martinez says
I thief going after another thief, what a joke.
Keith Burkhart says
I think Prime had a Law suit on Amazon anyway about a year ago something to do with Amazon wasnt paying what they say they would and that if you Hauled for Amazon they will make you go Broke something in that line of B/S ( well if you know anything about trucking there been more than 1 big companys went out hauling for them) But thats what these big companys do making to much money then Greed sets in and they want it all and theres no end to them wanting more Where all that money they have and making if they dont know what to do with it all maybe they should All PAY THERE WORKERS MORE how about that ideal big companys
MrYowler says
Seriously. Nobody whose opinion is likely to matter, is likely to confuse Amazon Prime with Prime Inc. It’s not even a little confusing.
Bill says
Huh? Amazon is a WORLDWIDE company. Probably the only people who know that theres a Trucking company named Prime Inc are Truckers. It’s a safe bet that at least 99.9% of consumers have bought something from amazon and know that their “PRIME” only means that you’re paying for expedited delivery of what you purchased from them.
This lawsuit should be DOA and thrown out! Meanwhile, Amazon continues to open distribution centers at a rapid pace while New Prime continues to fleece drivers.

25YR otr. I would never have the audacity to make such a frivolous claim as Prime inc. Has made “Good name and rep” if anything Amazon prime will help. Prime inc is the industry example of Rip off the driver scam outfit not including all the damage their drivers have caused to the industry and inflicted on professional drivers and the
Motoring public . Prime inc. Hold your heads down in shame and go away quietly.

Prime inc is trash. Back in 2009, right after truck driving school, I took a greyhound bus from okc to Springfield for their orientation. I thknk it was the 2nd or 3rd day I was there and the “doctor” called me in. He wanted to see my long form dd form 214. Anybody in the military knows what that is. I told him I got out honorably and it shows that on my short form and by law I dont have to show you the long form and by law you’re not supposed to ask why i got out. Long story short, that trash company that tries to act like they support veterans sent me home. To hell with prime inc.
MGE Dawn says
My question is what the doc’s business is in seeing your DD-214 to begin with… that’s an administrative matter, not a “medical” one
Adam says
Exactly.
BigDave says
Yep you dont have to show them jack shit. I walked out of their orientation 9 years ago. I can make more money local and be home every night being an owner op doing hotshot stuff and told em all to go to hell

He was probably looking for your SPN Number…:(
Grim Reaper says
Please Remember I Mortgaged Everything – including my rights. Says it all. I hope they both spend lots & lots of their money till the court date.
Keith says
Sounds like Prime Inc. thinks they are the cock of the walk. Meaning do they really think Amazon is hurting and bussiness is so bad for them that they need to piggyback on another carrier. Well there fussiness doesn’t need to do that at all. Prime Inc. trucking is only doing this because their probably the ones hurting and could use a big payday.
Of course this is only opinion and I’m just a crazy/stupid old 30 year truck driver. Y’all drive safe out there my driving brothers and sisters.
Adam says
Exactly. I’m independent now, but I’ve been with 3 trucking companies since then and none of them cared about any of that. I remember the week I was processed out in the military them telling me employers are legally not allowed to ask why i got out or to be requesting the llng form. Honorable discharge is all they need to know.
dave bean says
There is a certain validity to discerning the speed controlled fleet to one that obviously is not.
MrYowler says
Only if they never hire uncontrolled contractors to pull their trailers. Governed employees don’t make them special.
Cold War Vet says
Please Remember I Mortgaged Everything I Neutered the Cat. Both of them stir crap in a bucket pour it out still have crap. Amazon as a company great, contractors are sorry. This includes package delivery to over the road.
Mrs. C says
They thought they could bully you into showing them.
On another note I’ve never confused the 2 companies but I’ve been in transportation and logistics for 20 years. I would love to hear from some civilians if they confuse the 2. Not that it matters anyway because if you’re in the business you know the difference between the 2 companies. Smdh! They taking money grab to a whole new level!!
clyde goins says
Did Prime ,Springfield Mo. have it’s origin from “dollar truck” Midwestern Dist .Fort Scott Ks?.Another ripoff of the highest magnitude.
Daniel says
Hey Adam , inquiring minds want to know , we are all curious now , I got an honorable discharge from the USAF and I’m NOT skeered to show my dd214 long form, what’s on yours that’s so interesting? Did you contract a strange disease in the Middle East or punch out the Commanding Officer ?
Jillie says
What the hell is it to you what’s on his form?
Adam says
Exactly. Those were dark times. I got a buddy who everybody knows you don’t ask him why he got out. I asked him once and he looked at me and said “never ask me that again.” You just don’t ask guys in the military certain questions. Its common courtesy.
Adam says
None of your business.
Adam says
Only about 3 people know why i got out. You won’t be the fourth.

Pretending It’s My Equipment. Drivers have told me the lease purchase program is as bad as England’s. That’s pretty bad.
Craig Carter says
Prime doesn’t have a good name, they’ve been under cutting good paying trucking companies for years by offering cheap rates on delivering commodities that used to pay top dollar to drivers, I don’t think Amazon has anything to worry about
Corey Jackson says
PRIME a good company with a good reputation? Now that’s funny. Yeah if you call suckering poor drivers intoxthat5lease scam and basically putting them in the welfare line good then have at it. But the rest of us will call it what it is, pure crookedness and a ripoff. They need to go sit down somewhere.
Cc says
Plain Prime or Amazon Prime even Prime Amazon is not
Prime INC. Now The Lawyers can make good money over the two years until Prime INC realize that by LAW. Amazon do not use anything with Prime INC. By Law The state’s would say that name is taken and by law they will have to use another name and not reg. It. Now Prime Inc. is not the same as Prime alone or with Amazon that why the Law say they have two years for the D..A.. Prime INC. To stop before Amazon counter suit for islands by even thing Prime INC have anything to do with there business.
Clark blasdel says
Good reputation yeah right! Can remember back in the day in the early 90’s when you could see a prime rolled over in the ditch on a regular basis and driver would warn you to look out a prime truck is coming at ya!

I started with Prime back in 98. Worked there about a year right up until my transmission on a lease stripped out every gear from 2 to 7. $8k in damage that they wanted to charge me for not catching the damage on a walk around. Cause was a cracked flywheel. I turned in the truck and got a lawyer. They never said anything cause they knew the argument was BS. They were a trash company then and everyone knew it.
How many lawsuits are ongoing? How many other companies have a DOT substation built on their front drive?
Prime has never had a good reputation

I used to see a lot of Prime INC trucks in the ditch when I was trucking.
Crissy says
Though I am not a huge fan of Prime Inc. the majority of the comments are very clouded as to what the suit is “really” about so I will keep as simple as I can: This is about the time, money and perceived confusion between the two companies for confusion of the two when it come to reporting &records history, I believe the trucking companies main concern is for accidents, judgements & overall scoring(s) have effected them in thoe instances they have been confused with “Amazon” Prime & the time & cost alone makes this suit worthwhile to the trucking side, so personal feelings aside try to imagine if it were your company what would you do??? BTW I got my cdl’s thru Prime & I would not work for them again even if I could (difference between personal &business) don’t ever get them confused!
Sum Dood says
I admit, when I first saw one of those prime trailers I thought, “Oh, Prime Inc got some new dry vans.” Then when I realized it was Amazon I thought it was Prime Inc and Amazon working together. Then realized, again, no Prime Inc trucks were pulling those trailers.
I think Prime Inc has a case hear but it’s Amazon. Does anybody think Amazon will ever get the short end of the stick in anything they are involved in?
>insert eating popcorn gif<
Nicfadam says
I don’t see how this lawsuit holds any merit. I don’t get confused when I see the trailers. I also don’t see Amazon advertising need shipping call prime at Amazon. This is a waste of time on the courts. This is a huge over reach on behalf of Prime Inc. There however is a company that hauls the same freight as Prime called Primer and has almost the same letter font and everything and that is confusing. So I guess they will be next on prime inc list.
Yusuf Saggaf says
Prime inc sounds like western express, both scammers. Prime inc being confused with Amazon Prime should be an honor to their tarnished reputation
Tommy Molnar says
I clicked on the article about hair testing – and got directed to this Prime vs Prime article. WTF?

I’ve been reading a lot of these comments. It’s a good thing that the trucking industry exist because most of these people could not get a job doing anything else. Their intelligence level and lacking actual knowledge is incredible. I know people are gonna give me shit but I’ve owned a medical device company I want a couple other businesses successfully. And if this industry didn’t exist there be a whole lot of people that are too stupid to do anything else but drive a truck. Yes I do drive a truck now because I love it. But I don’t talk to most truck drivers cause they’re stupid or don’t speak English.
