A veteran trucker and 14-year USPS employee was shot dead during an apparent road-rage incident in Dallas on Monday.
Tony Mosby was driving his USPS truck on I-30 just west of Dallas in the early hours of Monday morning when an SUV pulled up, allegedly weaving erratically behind him. The SUV contained 25-year-old Donnie Ferrell and three other individuals.
As the SUV passed Mosby on the left, Ferrell was in the front passenger seat. He allegedly opened fire on Mosby, shooting several rounds from what authorities believe was a .38-caliber handgun. One of the rounds struck Mosby in the head and killed him.
When one of the other occupants of the SUV asked Ferrell why he had fired on the truck, he allegedly responded that he was angry about a hand gesture that Mosby had made towards their vehicle.
The following day, a $50,000 reward was offered for anyone who could help identify the shooter. Two of the other people in the SUV with Ferrell went to an FBI office and told them what had happened. Video evidence corroborated their accounts.
Ferrell has been arrested and charged with one count of murder of a U.S. government employee. If convicted, Ferrell could face up to life imprisonment and a $250,000 fine.

There is no law preventing drivers from carrying a firearm in a CMV. A lot of people believe that there is a law forbidding guns in Commercial Vehicles but it is a myth. There is nothing preventing you from carrying unless you are a company driver and the company forbids it. Most drivers that work for big companies were lied to by said companies being told there is laws forbidding it. But if you read FMCSA cover to cover there is nothing in there about guns. As I said it’s all a myth. With that being said if your a company driver the company can have a policy preventing it in their trucks.

Last I checked federal law still has death penalty. Example: A guy was charged a few years back found guilty, convicted and sentenced to death for killing a state police officer in Vermont. They don’t have death penalty under state law in Vermont but under federal law he was charged because people don’t realize killing a police officer is a death penalty offense under federal law. I’m disappointed to say this, but perhaps the best justification for the Federal death penalty, here, is that he shot the truck, resulting in a death.
Postal employees enjoy special protection agains threats, in the for of Federal statute, but apparently not special protection against being murdered. And it is deeply disappointing to think that the death penalty might only be on the table because of the truck, not the driver. This illustrates the valuation of life against property, in a starkly unpleasant contrast.

In texas unless its a peace officer or fireman its not capital murder which is our equivalent of first degree murder in order to get the death penalty here it needs to be that he killed in the commision of another felony. If they can prove it was retaliation they could go for it. But possible defenses for capital murder are lack of intent,lack of knowledge,insanity,intoxication and self defense. Seeing the time i bet alcohol was involved or he’ll say he just meant to shoot the truck and accidentally shot the driver. Its messed up but that’s the law. Chances are it will plead down and he’ll get less time if he doesnt have a record. Let’s just be glad someone came forward.

Using a firearm in the commission of a crime is a felony. But, you have to pay more attention. Ferrell has been charged by US Attorney for a federal crime. The Penal Code of the State of Texas doesn’t matter. IMO, the feds should back off and allow him to be tried under Texas law, first.

Accomplices to murder are already on the wrong side of the ethical line. Keeping quiet is likely more an act of self-preservation than an act of friendship, so snitching for money should not be a suprising behavior. These “friends” acted entirely out of self-interest, from start to finish, and if the shooter expected anything more than that out of them, then he didn’t know his “friends”.
In “prison mentality”, he should have shot them, too, and ditched the car.
The fact is that they are all terrible people. The right thing for the “friends” to do, would have been to stop the shooter, and/or report the crime as immediately as they could. Better still, they should not have even been in the car with the shooter – that’s how accidents get pinned on truck drivers when no other fault is available… “You could have prevented this accident by not being there!”. What kind of idiot hangs out with an armed hothead? How does the shooter have “friends” in the first damned place?

What I’ve heard over the CB between drivers, the aggressive talk, the “Who’s balls are bigger”, “Who’s going to kick who’s ass if they would just pull over.” It’s rediculous. I drove tractor trailers for 9 years out of the 20 years for the post office out of that same facility. I used to run the Hyster at night time and people would drive by from the freeway and shoot at the post office . My boss encourages us to carry while in the truck. I keep a .380 in the sleeper and conceal carry a 9mm while I make over night deliveries. There is no law against firearms in commercial vehicles. If anything should ever happen, hopefully I’ll be the one to go home to my family instead of a wooden box.
