GA trying to make me pay sales tax!?

    I spoke with a nice lady in the Cartersville regional office of the GADOR and she said you can only get the tax exemption if you have your own authority.

    Waah waaaaaaaahhhh

    Your lease with any carrier who has an authority to operate interstate is a replacement for your own authority, because the fmcsa reconginzes the lease to a carrier is an extension of the authority to cover your truck exclusively.

    Keep digging at that, ga has rolling stock exemption and it was revised in '94 to include the fmcsa recognition of leases.

    At this point I’d need to hire a lawyer to do the research and with a $3000 tax bill that’s probably not worth it. I don’t know who’s gonna listen to some standalone truck owner quoting the law to them when it’s the way they’ve always done it ‘round here.

    Ok, well you may need a lawyer but before that, maybe contacting your elected officials and the governor about it. I don't see a head of department of revenue but I expect that there is one but call them too.

    I hate states like this, they have laws on the book but there are people who just ignore it.

    In MD if I need to need anything with my truck and trailer tag/title wise I make the trip to main state facility because they're the only ones that know what they're doing.

    Research the rolling stock exemption. I think Georgia does it too.

    If truck is not tittle in ga. they are hitting you with something called a impact tax for bringing it into ga. thats rolled into the sales tax and that is why it is so hi of a tax if you want a ga. tittle you will have to pay the tax or no tittle, I got a truck that was tittle in LA. and owner lost truck over oil cooler putting oil in rad. and could not pay tow bill for them to tow and del. his reefer load, co.he was leased to came and got trailer and failed to pay his tow bill, I got it for a few grand and tax was more than I paid for truck, i tryed every thing to get out of it and if you do not have your own numbers you must pay them??

    I think I would get the form, fill it out with Carriers tax ID #, and go to a different MVD.
