Preventable accident?

So the company is saying this is a preventable accident. Backing into a dock and the asphalt collapsed causing the truck to go off into the dirt.

dirt isn’t the customers property so they don’t care.
Property owner responded to customer’s supervisor calling them. They’re not worried about it. Company is treating it as an accident not incident and possibly putting it on DAC.

would you consider this preventable? I do not.
Punishment is no safety bonus and being de-rated to 62mph.

 

It’s not a road it’s a piss poor paving job meant to be a parking lot. Asphalt crunched and the truck went into the soil AFTER.

If it was a drainage grate that collapsed would it be preventable? Keeping in mind that said grate is supposed to be something you can drive over, just like asphalt.

or if a dump truck is backing up into a location and the concrete slab was poured over a septic tank (against common sense but contractors do it) so the slab collapses and sinks the truck. Is that preventable?

 

I’ve crushed asphalt moving construction equipment in that line of work property owner gets told it’s not my problem take it up with the “expert” pavers that didn’t make a bed for it and spread it way too thin. But if he pays for material and labor we can straighten it back out.

 

And? It was still ON the asphalt. No curb or warning line to indicate someone should NOT drive there.
Using your logic if I’m sitting at a dock and the truck falls through the asphalt it’s the drivers fault.
