This company is so worried about their idle time that the over the road drivers cannot run the truck while they are sleeping. It does not matter what the temperature is outside. If your idle time is too high they send you a letter and then they give you two days off and they you can get fired. The idle time is figured with over-the-road drivers and region drivers (that can come home every night), the current average is 10% for their fleet (meaning over-the-road and region drivers). I would feel there would be some type of regulations against this seeing that it can cause fatigue to the driver, not to mension the risk to the health of the driver sleeping in these conditions. So my question is there something that can be done about this and is there regulations against this type of thing?
Can a company make you sleep in a cold cab.

Red, I think you are working for the wrong company. Any company that won't let you idle when the temperature is below freezing cares zero about your welfare. If you decide to change companies please ask about their policies before you take the job. Stay Safe

You could use 392.3.
But your sleeper berth is supposed to have "Adequate bedclothing and blankets", so they could get you there. Other than that, there isn't any reg. -

Hey try this, found it on the JC Whitney internet site. -
yes there is somthing you can do about it, but you wont find the solution in the dot regs. if you can , and you can just depends on how far your willing to go, you can ignore there stupid regulations till they fire you , then you file suit against them and let a judge decide. most drivrs wont do that for a thousand different reasons thats how these people get away with it, but if your willing to go that far you will win and that company magicly will stop doing such all you have to do is MAN UP and fight for yourself.

Redhart if that was the situation I was in, I would also make a notation on each log the temperature that night. In the event you went forward with legal help in the future this easy to prove bookmark of temperatures will be simple to prove and help keep things organized while also showing the hours that you spent locked into a freezer.
I have no idea what the health risks are but sleeping in 20 degree air has to be unhealthy if done so on a regular basis.
Here is a website that you can historical weather data for any location since records have been kept.

Of course, if you sue, you'll get a reputation that future employers may not like ala DAC.
Change companies... make sure you go with a carrier that prefers live drivers to ones who are popsicles or are cooked to death.simplyred1962 Thanks this. -
If you have sleep apnea you can use the Americans with Disabilities Act. Running a CPAP machine in a room below 45 degrees can cause hypothermia. That's why I am one of those guys Idling the truck almost all the time.
