Logging on duty while waiting for a load?

I stay on duty or drive all day every day, but I work Mon-Fri so not worried about my 70. Additionally, I load and unload myself so I’m always either driving, fueling, loading or unloading.

What I wanted to post was the importance of understanding that according to how the FMCSA defines on-duty time in some situations you can go off duty IF your carrier allows for it. The main point is to log 100% according to how your carrier instructs you to do so! If the carrier is wrong it is they that will get hammered by an audit. Because, I know for a fact that some carriers have a history of almost peeing on themselves when an FMCSA auditor identifies themselves on the carrier property they will do what they have to to avoid a civil fine. The 2 main things these auditors go after are logs and the driver's qualification files as required by part 391.

Unless you're OTR/Regional where your 70 is a factor, what he's doing makes perfect sense, especially with the low mileage. If you're fine with making $1,200 per week, the company probably has no problem paying it just to keep drivers there for when they do have work. That's not bad money for somewhere like West Virginia, but I can't imagine it goes far in California. Besides, they don't want to deal with the potential costs from unemployment and wrongful termination claims in a state like that.

 

I’d bet that driver is already fired, they just haven’t figured out how yet. Things most companies let slide, they will not give him any wiggle room on. 58 in California? Fired. Any sort of violation during an inspection? Fired. Fueling times do match your log exactly? Fired.

some guys will work so hard at being lazy.
