The NTSB actually does something worthwhile

While I think the NTSB does some good, I'm always skeptical of digital "recreations", they can be fudged. Nothing says guilty like a dash cam.

 

Fault is really easy to determine, even with this minimal evidence. Any word on the prison sentence for the truck driver?

 

They do not determine criminal or civil liability, but the NTSB does determine probable cause, which in this case was the truck driver's fatigue. Because they are a government agency, their recommendations were predictable: more regulations and mandating more nanny equipment for trucks.

I didn't search much further for criminal penalties because the results included stories about the piece of #### in Colorado who had his 110 year sentence reduced to 11 years and that still pisses me off whenever I think about it.

Meh, look, I just don't trust anything that is fabricated digitally. The dash cam stopped at 2:00, so as not to see the actual crash, and digitally fabricated from then on. It's dirty laundry for news ratings. We are given an idea as to what happened, but to take these animated videos as gospel, I say isn't always exactly what happened.

In my mind, there is no doubt where the blame should be put. Milk haulers fall under the HOS Agriculture Exemption. Under this Exemption, a milk hauler can run and run and run, even up to 900 miles or better before a 10 hr break is necessary . In my opinion, this driver fell asleep, but legally, according to the HOS, he was perfectly within the HOS.
