Seems to me that this is a pretty easy case to go and appeal. At least Wabash has the resources for that.

This is what I mean that we need Tort reform and enforcement of frivolous lawsuit prevention laws. The judge should have thrown this out right at the start and seeing they didn't, all the facts needed to be included, like they were drunk - which under tort reform would nullify any claim of damaged or wrongful death.

If I may comment after my recent debacle with the truck stop in Racine, Wisconsin. The truck stop ownership is irate over the fact that they really don't have a case to make against me or the trucking company that I worked for but they still went after the trucking company's insurance provider nonetheless. In my case and in the case of Wabash there is this bizarre inversion of blame and responsibility being put upon innocent parties in which circumstances out of their control prevailed and those actually responsible are trying to escape not only skate their own obvious responsibility but it also the predictable results and consequences of said responsibility. The Contranatural circumstances lead me to believe that such things are demonically inspired.

I would like to add, I did not see anything about the vehicle that rear ended the truck trailer. did I miss something or was that left completely out? I ask this because the car that hit the trailer no matter what the make, model or year , I am sure could have been made safer as well. I am not aware of the laws concerning this but if the trailer can be picked on then it seems the offending car could be as well. Of course this should all be moot , being the driver of the car was legally DUI when he/she hit the trailer with the car he/she was driving.
