I can’t stand that either. I’m waiting to get diesel and 20 minutes later One’s with Towel on Head come out w/duffel bag, lunch from Subway and the other hand full of whatever else they bought. While I agree that it's unconstitutional on it's face, based on other obscenity/indecency laws, I think it's going to be a long time before the courts toss it. Particuallary with the current make up of the court which has sided frequently with restricting speech.
You're assuming it's actually going to be enforced. At best, an officer will tell the person to remove/cover the offending item or be cited. If the person complies, great. If not, the officer issues a citation or arrests the individual. The DA will drop the case as soon as it hits his desk because he doesn't want to spend the time/resources and he doesn't want the law to get over turned. The person has no legal recourse as he won't be able to show damages and the police have qualified immunity.
More likely it's going to be selectively targeted at people displaying things an officer doesn't like. Again, I doubt actual citations/arrests will occur, but it gives the officer a pretextual reason to make contact with a person - run their license, search the person/vehicle/home, and otherwise detain/delay/harass. -
