Free speech absolutists of all political stripes tend to get oddly silent when they disagree with the speech being restricted.
That said, modern conservatives have a broad history of restricting free speech.

I know, all I'm saying is the playbook has changed. As soon as someone lawyers up and fights it, charges get dropped. In order for this to get challenged they're going to need a DA who is willing to prosecute. Most indecent speech charges get dropped.

Basically provides that simply that it offends you, does not allow you to infringe on the person's right to say it.

I could respond with truck nuts don't meet the standard met in Miller v. California, but that's not my point. I agree with you the law is unconstitutional. I'm saying that they're going to get around it by denying standing. If Georgia had dropped the charges after Cunningham pled not guility, there would have been no court case to overturn the law. Over the last decade or so, that has become a common tactic in cases where police overstep the mark - particullarly when the case goes 'viral'. By dropping the charges, the person has no damages, thus no standing.Opus Thanks this.

Cop who arrested man for vulgar bumper sticker is entitled to qualified immunity, federal judge rules
Basically, cop pulled over driver for 'obscene' decal, cited driver and ordered driver to remove at least one letter from the decal. Driver refused, was arrested for non violent resisting arrest, vehicle towed. Charges were immediately dropped, driver tried to sue but because he had no damages he could only sue for false arrest, which gets denied under qualified immunity.
That's the play to enforce unconstitutional laws - drop the charges against anybody who challenges it and avoid any court ruling.Last edited: Apr 5, 2025
