E-LOGS !!

    I won't let the details get in the way. While I have been a very conscientious commercial driver for the last 3 decades, I have to admit that I view the regulations as a guideline and not unwavering. I will move to a safe place to park, laden or unladen. And I do that on the EOBR as Off Duty Driving if I am already over the 14 and on a break. Note, I said a safe place to park, not as a way of closing the gap between pickup and delivery. The right of the owner of the property carries greater legal weight than the FMCSA regulations. If I need to leave to find a safe place to park, I will do so without any fuss. And a first year law student can win that one in court.

    yeah, PC is a tricky subject. However once loaded it's actually not available. Is it safer to drive somewhere to park, sure. So just log your violation, it's not the end of the world. However using PC is creating a false log, that is going to be a bigger issue for you.

    The company I work for doesn't provide for an off duty driving line. If the vehicle moves, someone must be on the drive line. Meaning, in order to get a 34 hour restart, your vehicle cannot be driven. No running over to WalMart, the movies, or anywhere else. In that sense, perhaps the notion of elogs making for safer drivers comes from drivers being forced to actually get 34 hours rest. Or, perhaps forcing them to get execise by walking instead of driving to errands they'd previously do by driving their trucks. Those would be the only things I can think of for making a statement like that. I actually like elogs and certainly never expected to. There are a couple of ways I'd improve them if I could. One of which is the 8-days tab. It's kind of confusing when trying to determine if you'll gain or have enough hours to take a load.

    That is the situation with many company drivers. For the O/O that a carrier tries that with, I will be more than happy to refer them to my son, who is an agent with the IRS. IRS takes a dim view on a carrier trying to say when and where an owner can use their own equipment when they are not doing work for the carrier. That is a flag that there is no O/O at that company, but in fact, everyone is actually an employee. Makes for some real nasty times if the IRS decides they want to reclassify O/O as company employees. Just ask Fed Ex.

    My carrier tried to limit O/O off duty driving early on. I think is was around 15 miles or so as best I recall. All it took was a hint that I would give my boy a call at the IRS and they quickly rescinded that position and made it unlimited. I actually put it to the test early on. I decided to use the tractor while at home to make some errand runs to several locations. Total trip was around 110 miles. No problem.

    The FMCSA regulations allow for an off duty driving status. True, a carrier has the right to limit that with their own equipment. They pay the bills, they get to decide. Until I see their name on the title to my truck, they have no say. I pay the insurance, so they have no skin in the game when I am doing my own thing, on my own time, in my own truck. Of course they could rescind the contract. That is their right as well. But then, they would be just shooting themselves in the foot.

    E Logs are great. I love them. I don't have to do nothing. No getting on Ch. 19 or looking on a map to see what city you are in. Fuel and leave in less then 15mins. Automatically does your split sleeper birth:biggrin_25520:

    I've been on e-logs and paper.Like paper better as most e-logs are connected through satellite and I have had no signal and get put on line 3 or 4 after I logged onto line 1 or 2.:biggrin_25513:Big hassle getting logs dept.to change them.I've never had my paper logs put me on line 3 or 4 while sleeping.:biggrin_2559:

    Elogs are a joke. EOBR is a joke also. Glad I am an owner operator as I can easily keep moving to another company that is not using the crap. Keep moving till I am forced to get my own authority. When they try to force it then I will sell out. I am all about good regulations but these two things are bs.

    I thought the same thing. I was going to pull my truck if forced on EOBR. I decided to give it a try when it came along and then pull my truck if it didn't work out. Well, it has been in my truck for a year and I am not pulling the truck. Not that big of deal.

    Oh... and my revenue is up almost 10% for 2011 over 2010. Boy, that EOBR is sure a bad, bad thing isn't it.

    Here's a scenario: my buddy is under a load, pulls into the T/A for his 10, drops the loaded trailer and goes over to the shop for his oil change. On paper he's doing his 10. On Elogs will it say the same thing or bust him?
