Got any physical proof you hit the delineator? Drive for a larger carrier? No proof, never happened. Serves the bugger right for tailgating.

Come to think of it, it happened inside a curve, and there were several other delineators that were already knocked out.

I'm sorry, but what the heck is a "delineator"? Personally, I prefer orange barrels or Schneider Eggs.

I will never understand why drivers get so excited about a tailgater. If they hit you, then legally they were at fault. If you run something over, and they don't have time to react, they will be legally at fault, for following too closely. To let some dummy who is trying to encourage you to go faster, get you all excited, is a rookie thing to do. Pay attention to where you are going, not where you have been.

Instead of the Orange Barrels they are the Orange Poles or Metal Poles with reflectors they can extend in height for roads that get snow.

You are responsible for hitting it. Any damage to your truck or the construction companies equipment is your fault. However I wouldn't say that the you are responsible for the moron behind you.

I was coming through Houston one night and had someone tailgating just as you did and there was a sofa in the road!!! I moved over quickly due to it being night time and visibility was null and the car behind me T-boned the couch on the interstate! Cars and cushions went everywhere! He probably spun around 6-7 times before hitting another car in the rear end and then the guard rail. Had he not been so far up my butt he could have easily avoided all that. Lucky he lived!

In your case man, I wouldn't sweat it! Hell a lot of times in those construction zones those cones and barrels get moved around anyway and can easily be in position for running over or taken out. My wife once crushed a Schneider egg and it was the funniest thing! She started crying and I couldn't stop laughing!

Instructors are teaching awareness of taligaters - and advocating increased following distance to compensate.

Heading south on 301 between the MD/VA line and I-95, there is an area of bridge construction where traffic is funneled into a single lane with concrete barriers on each side. Of course I'm being followed by a line of 15 cars wanting to push me through. As I crest the hill, there's a half-crushed schneider egg on its side by the left side barrier. I move as far right as I can in the single lane (not able to stop in time), but the trailer tandems clipped it, bounced it off the barrier and spun and disappeared behind the trailer. I'm not sure what the cars behind me did, as I grabbed another gear and continued on towards the interstate. :)

Chances are the barrel just scared the poor four wheeler enough that he / she decided to back off. If you don't hear from the construction company about their barrel within 5 to 7 days put a $20 bill in an envelope and mail it to them with your apology.
