California ticket advice please

    I would have pulled over thrown open the hood, put my triangles out and placed all the operators manuals on the dash. If the local highway patrol came by to bust my shoes I would have said I had a high engine temperature condition and was reading the manuals while the truck cooled down so I could get it to the next truck stop. If the cop caught me napping, I would have said I had a call into the mechanic and was waiting for a call back on advice what to do. Either way, you'd have "plausible reason" for your emergency stop.

    Please note.

    I replied the way I did.

    I am not caring what you did with your stop and all.

    I addressed this to make an obvious statement for drivers to not put themselves into such a position.

    If you do not like it, so what.

    Sorry, but in the eyes of the law, This is not a "emergency stop", He needs to plan his day a little better, Although he should try and get the ticket reduced to a parking ticket, better for his CDL, but this is the OP fault, the HOS doesn't say "you must drive 8 hours and then stop for 10 minutes", It does say, "you must take a 10 minute break after driving 8 hours, he could have Easley stopped on his 7 hour or 7 1/2 hour, the rule is start driving, Don't you dare stop! you drive 8 solid and then! you better stop no matter ware you are and take 10, This SO Easley avoidable, To the OP, Find a lawyer that can help, If you have a clean record, He will more than likely be able to get this to a parking ticket, but you will still need to pay the fine, plus any fee the lawyer will want to take the case, Just try and use this as a learning lesson, Plan your day a little better, I've been on the road many years, never had a load that I could stop to what ever, Bathroom break or what have you, Don't get me wrong, I'm not trying to side with the CHP officer, Communistfornia has never been trucker friendly, And with all the new screwed up regulations there is, you need to do what ever you can to protect your CDL, don't push the 8 hours before taking a 10 minute, Drive 4-5 hours stop at rest area/truck stop, walk inside drain the vain, climb back in and get rolling, Boom! 10 minute out of the way, Good luck with your ticket

    Yes. Thought of that while reading the citation. Too late. Any help on Joshua tree court or California law?
