Everybody I checked with says I cant just get a wrecker to go get it(They just not going to start moving other trucks just to get to mine without shop owners permission). Got to settle his bill of not finishing my truck. ooida(only interested in class action, not small guy) says I would have to pay his bill in full, then take to another mechanic to finish job, then take him to court for the other mechanic's bill and lost wages(which I doubt). The newer motor is in it but not hooked up. The hood and rad are setting in the floor by the old engine. So far this is a real expensive lesson, but my uncle always told me if you learned anything it was money well spent BULLCRAP.

Who said it won't hold up in court?
You have a way to producing the texts on your phone with access to the phone company's records so you can also change them?
Here is what you do,
Start with the state, call the agency that licenses the mechanics and shops, ask them how to lodge a complain to the state on the shop and owner.
Then go to the state AG, ask them what you can do, explain in detail how this happened and why.
As you mentioned, you will have to pay them but not in full, you can ask for a bill of the work done to get the property released, if they refuse or tell you that you have to pay in full, then you go back to the AG and tell them what's going on, they may step in and start an investigation or advise you a next step.
A lawyer may help with all of this too, you can find any lawyer who is within the state the truck is being repaired.rank and bullhaulerswife Thank this. -
Hmm, a text message can be sent from anybody. He doesn't know if he was texting to the mechanic or a 5 yr old. A phone call can be proved with voice and written agreement proved with signature and handwriting style.
I can easily fake a text with the name Osama and the phone number 911 with just an app -
Funny story....I try that app with 911 as the sender....and if you reply back it actually sent to 911...so don't try it

Now that's funny!!!!

Call the Attorney Generals office first. That's what they are for. They represent the Consumer.......for FREE!

around here people go to the local maqistrate first and see what kind of legal papers can be took out against the guy. Then we follow his directions and see what happens,it usually works out

Guys thx so much for the info and help. I have to be honest here the attorney generals office never crossed my mind. I have talked to several lawyer's and not one of them suggested that. Not even ooida. I will get that ball rolling in the morning. They(repair shop) have even got to where they wont even answer our calls(wife and I). So we will see what happens with the AG office in the morning. I feel like he has messed something up on my transmisson, it's an Allison automatic. That's the only thing that even remotely crosses my mind that could have went wrong in order for him to do what he's doing(it's ten grand for one, just bought that one last year). Unless he's trying to get my truck somehow. He cant get me for storage on an unfinished job(I think?). I will keep everyone up to date as I learn. Thx again for the help.
Big Don Thanks this. -
Sheesh that guy is a grade A scumbag, how does he think he'll get away with this? Like someone would just give up and let him keep their ####... Good luck.

Yes he can declare a mechanics lean on the truck with some excuse of billing you and you failed to pay. One reason why you document the issues you have with dates and when you talked to him with the date and time.
