Just draw up a quick waiver stating something along the lines of "I, (officer's name + badge #), as an officer of the law, hereby order (driver's name) with (company name) to move a CMV from a safe location in violation of the HOS. I understand that (driver's name) is required by the federal regulations to take a rest break, and that my order is in direct violation of those regulations. Therefore, I personally assume ALL liability for any damage, fines, or penalties incurred by (driver's name) while attempting to find another safe place to take the required break.

    (officer's signature)
    (officer's badge #)
    (officer's department address)
    (officer's department phone #)

If it doesn't get signed, the truck doesn't move.

Stop acting like this is some written in stone law/rule with no flexibility.

A LEO can ask you to move for many reasons(I.e. Illegally parked, safety, etc), you can't pick and choose which you're going to not be indignant over. Never been to a shipper that woke you up to move/unload at unscheduled time? Did you say, "no, I don't want you unloading me, I'd rather wait for my appt time" or "hel l yeah, which dock?!?!"

Suck it up and move, but do it safely, if he woke you up from a deep sleep, take your time, if you let him pressure you and you have an issue, it's all on you. Comply safely.

I really do hope newbies know this is a very bad idea. You can still be screaming at the trooper with the unsigned homegrown waiver in your hand as that big expensive wrecker tows your rig away.

US marshals won't do a thing. It's not their job to rescue truckers from the DOT. People still actually believe that crap??
