It's cracks me up. Why not try them first, instead of throwing a crap fit. So many carriers require them now. You might end up getting those peeps who want you to run illegal all the time instead. Plus I have never had an issue with pay here.

that is what every contract I've ever seen says. It is taken out of the FMCSA/DOT regulations for leasing, they are essentially quoting the governing regulations.

I'm sure EVERYONE here has read the regulation: https://www.fmcsa.dot.gov/regulations/title49/section/376.12

Again much ado about nothing. Mercer is trying to satisfy legal requirements between federal leasing regulations and employee/contractor discernment at both the federal and state levels. Just because something is in a contract does not mean it will be enforced. Mercer decides to pay us about as fast as can be done, definitely better than 99% of other companies, yet somehow people find a way to complain anyway.

    From Mercer fb
    RECENTLY ANNOUNCED FROM MERCER:

Good afternoon Mercer Family! I wanted to update you all on all of the controversy surrounding the new Mercer Contract. We have decided, after careful consideration, to remove the "Billed Amounts Uncollectible" section (Appendix B, section f, paragraph ii), completely from the contract. This is the paragraph that states that Mercer has the ability, at it's discretion, to not pay a contractor for a shipment if Mercer does not get paid by the shipper. We stand behind our commitment to our contractors, and we hope you continue to have the faith in us that you always have had, that you will be paid for the work you perform. This change was officially effective on all contracts signed 2-26-16 and later. PLEASE NOTE: If you have already signed the new contract before this date, Just stop in and see Alan Hoyle, the next time you are in Louisville to receive the copy of the current and updated Appendix B. (Jason)

As if on the day it becomes mandatory they could get installed in all the trucks. Plus our CSA score is taking a beating largely in part to, imagine this, log violations! And against our peer group which determines our rating, just about everyone else has gone to ELDs which makes our score even worse. Some people just don't understand that things change, for better or worse, they will change.

Where at? I need one more to be legal in WA

That just amazes me. Most of us don't drive enough to even worry about Elogs. There are going to be no places to sign on with very soon. How long can someone with there own numbers go before they will have to go on Elogs? I understand not liking change but I don't know if quitting is the answer.

I leased onto a local company. Out to the west coast and back. One reason I leased there was because many companies I was interested in were going elog.
And their terminal was four miles from my house.
Anyway, I didn't earn what I could have elsewhere.
And one week they wanted me to make the round trip in 6.5 days. We compromised. I did it in 7.5 days. They didn't seem to care about hos rules.
I do seem to recall telling them I would run as hard as I could log on paper (one log book).
So, yes there are companies that still expect you to run illegal.
I don't mind exceeding the hos laws a little under certain circumstances if I can do so safely. But I don't want it to be the normal everyday thing.
Btw when I would leave home I would run 850 miles the first day to be on schedule to deliver on time in California. I didn't stay long.
And it didn't pay well either !
