I don't think anybody is saying to be off duty while fueling.
Off Duty while waiting to fuel.
On duty while fueling.
Most companies will catch that in a routine audit if you fuel off duty. Way before the DOT officer.

Where they get ya at is logging off duty for load unload if time is short. It's more believable to log sleeper, which I do. Log 15 mins load/unload then the rest of it in sleeper.

I've been told you can prevent that "adding those minutes to the Drive line" by shutting off/setting brakes for 1 minute or more after you make that brief move. If you just set brakes and idle and then drive, it will add the time from when you first made the small move as driving time. For example, you idle while fueling, pull-up & go get receipt (idling), drive around the truck stop to see about parking, find none, stop & idle, check your phone, and then start driving Qualcomm will start your driving time from when you pulled-up after fueling, and not when you drove to the exit. If however, you shutdown after fueling or while checking your phone, then re-started, released brakes, and headed for the exit. Qualcomm starts your drive time from when you headed for the exit. At least that's my understanding from the last few months.bamalife123 Thanks this.

Our safety department made it clear to us that any time logged "off duty" or "sleeper" that is while waiting for business related activities will be counted towards the 70 and 14 by DOT and in audits.

Well that explains it-- half the DOT officers are deplorable.

A plaintiff's attorney is likely to do the same, as technically you SHOULD have been logged "on duty".
Now, you can be attending a CMV being loaded or unloaded from the sleeper berth, but you can't log it "off duty". Same can't be said for remaining in readiness to operate a CMV while waiting in line at the fuel pumps, though.
Just because you log to save hours doesn't mean those hours won't be taken back if something happens down the road and your "off duty" status during those times is challenged...and just because the computer "allows" it doesn't mean you can't get in trouble for doing it. -
With elogs it isn't a problem. But with paper logs it makes them harder to read. You don't want the LEO to make a mistake and see something that isn't there. I think that's why people avoid stuff like that and just make log changes in 15min blocks.bamalife123 Thanks this.
