But to address your idea of distracted driving--
Follow my logic here. Hands free body cam mounted on the driver's forehead sees everything the driver sees. So you're saying that the driver looking down at the speedo is distracted driving? -

Here's the problem though. There are MILLIONS of others just like this stepdeck driver and that nitwit in your OP. You're fighting a losing battle. Really the best course IMHO for you or anyone else is to adopt a defensive posture and worry more about dodging and steering clear of the likes of the aforementioned nitwits. I don't condone what the dude with the stepdeck did, I wouldn't do it myself. I see it all the time though and it's far from a mortal sin.
I think you weren't paying attention and were caught off guard when he showed up there. You couldn't find the gear and had to come to a complete stop. You should have seen it coming and either slowed to let him in or closed to the gap to discourage him. I'm all for leaving space and keeping rolling but at the end of the merge point if you're going to leave the space you should know someone is going to make a run for it.
What was going on behind you? The guy probably couldn't find anyone to let him in and took his best option. Again, not agreeing with what he did but it's far from being the grave sin you are trying to make it out to be.

I get the feeling that you are afraid of that? Perhaps worried that driving creatively around the more safety conscious is going to be a thing of the past which I know, is sad like extinction of the dinosaurs, the end of the cowboy era, or the end of the space shuttle program. -
