    Without replying to that, I'm just going to say this. When I refer to pedantic bullcrap, I'm referring to the fact that rather than going after any log violations or potential violations, you went after his misuse of the term "safe haven", which is something which is so common as to be correct, although not the same term that gets used in the FMCSA regs. That bit of pedantry gets thrown around so much and it distracts from the real issues, which you have outlined in this post rather well.

    I'm sure others have pointed out some of the poor choices you made of things that you could control so I'm not going to beat a dead horse.

    I can tell you I was in your shoes with the same company in a similar situation. That forced dispatch I told them I didn't have the hours for and ended up in violation by +2...was my last.

    You have to protect your cdl. The company, any company is not going to do it for you. If you have mouths to feed they need you to keep it clean as well.

    Three months is enough to move on to a better outfit that isn't going to force you to have days/weeks like this. The time you spent chaining up I would have spent searching for new employment.

    Everyone else covered where you messed up. @Moosetek13 and @scottied67 gave you some great company advice.


    And as for fuel solutions in general, we can get fuel anywhere they accept comdata and have a station code (just a point of info.)

    Please see Swift at it again thread.

    Lulz.

    No one could make the newbie stories up if they tried.

    I only read the first two pages, how fast were you going with chains on for how long?

    I lay about 99% of this at the wonderful ownership / management of Swift.

    Let's chronicle your adventures you've posted since you started at Swift.

    1) Instructor squashed on backing range.

    2) Trainer, by your own posts, was derilic.

    3) DM / Operations that sends brand new driver into the teeth of the worst winter in years.

    4) You almost cause fatality number 2 related to Swift, and got lucky.

    I want any one of you to please explain to me how this trucking company is not a menace to our F society.

    I so hope there's an attorney or three that surfs these pages for ammo.

    JUST WOW.

    I mean it. I need someone to explain to me how this companies SOP is just, and justifiable.

    Well to me that's slavery. You have a half a tank of fuel, getting to your next fuel stop will burn two third of that but then you get stuck in a snow storm 5 miles from the nearest ts where they are the last fuel point for the next 200 miles and you can't top up?

    Don't care how great the company is, I would never work for them, you can't make decisions but worse you accept it as ok.

    @RedRover , regarding your service failures which this time you may have avoided. I understand the pressure you are under to make miles and get paid. Some of the things that happened to you this week in question could have been logged and documented in such a way to protect you from SF's.

    Swift's Plus 1 program along with forced dispatch did you no favors either.

    Regarding the fuel stop that you thought would take "2 hours" (come on, that is anxiety talking...) but still in that situation a good judgement call is warranted. Instead of letting the pressure of time to distance ratio get to you, just log the time waiting for fuel as On Duty as required exactly by the book anyway. This will protect you from a SF, no campany can hold it against you that you ran out of legal hours to do the job.

    Flat tires are a Breakdown which is also a legit reason to avoid SF's.

    Having your truck struck by another truck at a customer is also a legit reason.

    In your original post you asked if it was OK to drop trailer and bobtail down the hill, YES. The trailer had two flat tires ? correct? put your kingpin lock on it and go get your own help via phone/qualcomm signal. Confirm help is on the way to the trailer and return to it.

    As far as the chick leaving the scene of the collision. Still need to get a police report going on for that at the moment. Now you said there was no phone/QC signal right there correct? Another good reason to bobtail down the hill and report it. Should have gotten pics/video of her and her car as well especially her license plate. She may have gotten your info and is planning to sue the company and the driver (you). Consider if she had a dashcam showing date/time stamp, your truck number and your tires strking her car. She says she went down the hill to get a cell signal and when the authorities follow up they see you didn't report it to your company or at least the cops see. Always protect yourself from the public and from your own company who will throw you under the bus so fast.....

    Wait until he gets all the tickets during the audit, Swift's CSA score can't go any higher probably, but every little bit helps.

    This whole thing sounds like scottied67's dog ate my mirror, my chains, tires, log book, and common sense to me.

    I'm only on page 6 lol.

    I still lay 99% on their operations though.
    That's big boy trucking in that area right now, they wanna throw him to the wolves or sink or swim, then they shouldn't mind the smashed equipment, injuries, late loads.

    God love one of you clowns that does that to someone I'm a kin to though.
