I thought you couldn't be under dispatch either.

For example, I cannot off duty drive empty if I received a load from dispatch, even though I have not picked it up nor driving to pick it up yet. Until that load is delivered or given to another driver, I'm responsible for it and thus can't do off duty driving, even if I don't have physical possession of the load.

Does the law say you can't pull an empty trailer doing off duty driving? Usually after completing a load, ill log off duty driving and head to a truck stop with my empty until I get a new load. Company has always told me that's fine.

 

Your understanding isn't quite accurate.

You are correct, you cannot be under dispatch. But what that means is you cannot be advancing to pick up or deliver your load. You could be on your way to pick up a load. Stop for a break/rest. Use personal conveyance to go to a restaurant (for example; per FMCSA guidance). And then carry on to get your load. The same if you have a load. Stop, drop the trailer. Use personal conveyance. Then return to your trailer and carry on.

The FMCSA Guidance fir personal conveyance says you must be unladen, but they do not define what that is. Some take the position that it means bobtail only, and some take the position it just means an empty trailer.

What you are doing after getting unloaded is a violation and your carrier is wrong.
