You run out of hours, not allowed to park on property for your 10

Your right. I just wanted to add drivers also bust curbs and plow up soft ground after it rains. Then you have problems with loud trucks coming in and out all hours of the day and night. If you look deep enough some parking has been lost because of local zoning laws. This is a complicated issue. This zoning issue is why some places don't have truck stops. However you are right. The root of all of this is the irresponsible behavior of drivers in the past.

 

I would say that the root of all this is not enough truck parking in rest areas along interstates. Every closed rest area is almost a crime against the motoring public. Rest areas are not cheap, but they are much cheaper than the expenses of dealing with trucks in metro areas.

Build a rest area every 20 miles, and sell the rights to put a truck stop in them. Keep trucks on or near the interstates which are designed for them.

Basically, a lot like the way toll turnpikes work, without the tolls.

 

Apples and Oranges. I was not taking about the overall CMV parking issue. I was ONLY speaking to the problem with the thousands of parking areas that have become lost.

 

When that happens and I'm empty I go off duty personal conveyance drive to nearest place to park, make sure you note in comments why the personal conveyance you should be fine.

 

Yeah..... Just dont get into an accident with a civilian. The lawyers will do more than "rip" you.

Yes, even if loaded, at least at my company. They gave us a line 5 on the ELD for just such occurrences, and or personal conveyance. I had to use it yesterday to get to the truck stop when I ran out of hours at the dock.

 

Certainly better to get moved somewhere safe and off of streets and highways. Parking along streets in the dark is a good way for someone to run into your ICC bumper and kill them selves. In this game, you’re dammed if you do and dammed if you don’t so the best you can do is not be the cause or party to the injury of another because of their own stupidity and poor driving habits. The fact long term parking may have “been legal” will not mean much to many in a position to inflict legal action against the carrier and driver.

 

Just another reminder since this got resurrected. The FMCSA will not take any action against you or your company for busting those clocks in situations like this. Just make sure you note it in your logs and don't make a habit of doing it. A good state DOT officer should also not bother you about it either. It is an accepted fact by the FMCSA, Groups like CVSA and the carriers that drivers sometime have this problem. You get hung up like this stop crying about it and go find a legal place to park. I drove for years and I have discussed this with many Safety Critters. All of them will say this. You CAN NOT use the FMCSA HOS rules like a club and refuse to leave. You do so and you open yourself and your company to a large tow charge.
