Tail light out ticket

Just pop the light out; if it is not there, there can be no requirement for it to work.

i think those are the riveted lights. if so, no way he can just pop it out with out a few hand tools.

 

I've always heard the expression: "If it's not there, it can't be ticketed"

From this, I've gathered if the offending light is removed, physically from truck or trailer, and there are others that fulfill it's role alongside it, then there can be no ticket issued, because there is no light malfunctioning to give the ticket to.

I'm not sure how true this is, but it makes sense. If you've got more than one brake light or signal light in the back, pull out the one that doesn't work and roll.

Missing or defective equipment gives the officer a oppurtunity to write up a violation. Most or all CMV trailers require a working marker, brake and turn signal/flasher per DOT.

Can someone cite the code enforcement?

You don't have to remove anything. If it isn't REQUIRED, it is auxiliary. Auxiliary lights are NOT required to be operational.

Do you have AT LEAST 1 tail light on each side? AT LEAST 1 brake light on each side? AT LEAST 1 turn signal on each side? Center 3? License plate light? If so, they can't write you up for other lights that happen to be burned out which are extra on the back of the trailer, above and beyond what is required.

 

I was having a problem with my tractor license plate light so I took it off and passed dot inspections.
