30 minute break

    I don't believe the driver needs one in this scenario but I want to get word from the experts. A driver was on duty for 11 hours; driver starts with a 30 minute pre-trip then drives for 4.5 hours at which point he shows on duty not driving for 30 minutes. Driver continues driving for another 3.5 hours and then shows another 30 minute on duty not driving and ends with an hour and a half of driving. Is the 30 minute break even necessary here?

    He got three 30min breaks. You start the 8 consecutive hours of on duty time from any period of off duty time of at least 30 minutes.
    Edit: That is wrong. He didn't get any breaks. On duty not driving is not off duty. Thanks for catching that @chickentanker

    off duty is required for your break, not ODND

    Sleeper or off duty - not on duty, for the break.

    GOTCHA! I was confused on it also then. Thank y'all for responding. I think the driver was as confused as me. LOL

    Be careful not to take your break too early if you have a long day ahead of you. If taken too soon, you'll end up having to take a second one to be legal. It needs to be off duty or sleeper as mentioned earlier.

    I usually suggest to the drivers that they take a break around hour 7 or 7.5 just to keep them from needing a second. I'm still pretty new to compliance, only started in December.

    also dont take your 30 minute break in the pull forward lane of the fuel island

    That was a violation if done the way you stated. There was no break taken.
    Off duty, or sleeper.. that's it.
    No driving after 8 hrs past the forst moment you start your day until you do so.

    You know... just like kindergarten.

    I talked to him. First thing I asked is where on the log he took his break. He indicated one of the 30 minute ones for on duty not driving. We had a talk about when to take breaks and how to log them. He is new to logging his trips because he was always short haul before. I had him amend the log to reflect what actually happened.
