What company do they have their Trucking Insurance with? If you can find that out, you can call the insurance company and tell them what happened. They may check into it as Insurance Fraud, then you can Appeal ant DAC dings.

If they are self inured, no company to call. And unfortunately a lawyer isn't going to do much for you, probably not worth what it would cost you. But definitely Appeal to any DAC ding if it gets reported.

This is one of the stories I tell all of my trainees:
I was delivering in Buffalo, NY. Customer said they had parking, role up early evening and find the docks. No place to park except in the dock and it looks like a PITA to get into, but I manage. Start cooking diner and here comes another driver. I get out to help him back into a dock. A hour later and here comes a third truck. Both the other driver and I get out to spot, and god knows how we managed to get him into the last dock, but we did and I went to bed, setting the alarm for 0630 as I had a 0700 appointment, and the sign on the door shows they open at 0700.
0600 rolls around and a guy starts pounding on doors. Guy is pissed off, no clue why. When I give him my paperwork he barks that I'm not at the correct set of docks, and yells at me to to go around the corner and back into dock 3 (past the "No trucks beyond this point" sign, where it turns out there is a nice wide lot we could have parked in).
I back in, then lay back down. Guy comes out and tells me I need to pull forward two inches as I pushed the dock bumper up. I go back and look and sure enough the hard rubber stopper is all jacked up. I pull forward, he unloads then tosses the paperwork thru my open window. On the second page of the BOL he wrote "driver damaged dock".
So I started working the process:
1) I stayed calm. I did not tell the guy what I thought of him, his attitude, or his apparent attempt to trap me into a "failed to report accident" situation
2) I took pictures. I showed the dock bumper I allegedly damaged. I had pictures showing the rust, showing that instead of a single bolt holding the matting together they had some steel cable, which was rusted through. Then I took pictures of the dock next to mine, which had been recently replaced, showing what the bumper should have looked like.
3) I called the Schneider INS accident line, and went through their whole dog and pony show.
4) I called my DBL and talked with him (copying him on the pictures)
The incident was initially ruled preventable. My DBL kicked it up a level saying "look at these pictures", and it was overturned.
So you and I had a very similar situations with vastly different outcomes. The difference is that I took as much control over the situation that I could. I initiated the conversations with Schneider and my DBL so that when the customer makes their claim Schneider is prepared and not caught off guard. When the accident report came to my DBL he was not blind sided and was ready to engage on my behalf.
You did nothing to protect yourself or the company. Thus you ended up getting dinged with a preventable.
As an aside, I watched a guy drag his open door along half of the trailer on his blind side. Yes I tried to get him to stop, but his window was rolled up and he had the radio on, so he could not hear the massively loud scrapping or my own shouts, only stopping when I banged on his door. Driver pulls out, the inside of his door is scrapped to heck, as is the trailer next to him. The trailer door opens and closes no problem, so the driver says "No big deal" and got pissed when I told him I was going to report it to security (the trailer he hit was not one of ours). So just because your trailer doors were not damaged doesn't mean you didn't jack up their wall.hardworkinman, larry2903, NYCNick and 3 others Thank this.
