Well, I've never seen this one before. It is more absurd than most, but not beyond the pale.
In a previous version of my life, I was a litigation paralegal for 10 years. In fact, the longest trial I ever assisted with took place in the very courthouse where the infamous $2 million McDonald's coffee verdict was handed down just one month after we left Albuquerque. Our jury was full of ####### too.
Lesson learned? The vast majority of lawyers are greedy liars. This is why most politicians are lawyers. I'm glad I never went to law school, though many encouraged me to do so. I don't want to be counted among them at the final judgment.Last edited: Dec 8, 2018

You can do a search here on TTR. But he judge threw out both the judgement against Werner and the one against the driver. In addition the plaintiff was ordered to pay all of both defendants legal fees.

I googled around a bit to try to find the final result, but to no avail. Just FYI, at that worst trial I ever participated in, the jury awarded the other side over $1 million. The trial judge remitted the damages down to $949. (Yes, less than $1000.) The New Mexico Supreme Court gave the plaintiffs back their $1 million.
Don't let anyone ever tell you that Supreme Court justices (whether state or federal) aren't influenced by politics. That was over 25 years ago and it still sucks. There's a certain chain of stores that I have never done business with because of that case. -
Not true. The above posts are based on this post which references an unsigned order and which predates the Final Judgement of July 30, 2018. The Final Judgement upholds the award.
Further, an appeal has been filed by Werner and they are continuing to register a charge in their financial statements (most recent: third quarter 2018, ended Sept. 30) regarding the "adverse jury verdict" (why would Werner appeal and register a charge if the case was thrown out?) So, Werner is still on the hook for the full amount, pending the outcome of their appeal.Lepton1, gentleroger, Bud A. and 1 other person Thank this. -
I logged into the district clerk site and noticed one thing...the case isn't listed anymore...plenty of cases listed that have been completed too..but this one is no longer listed.
