By law they have 45 days to get your money to you.

Some companies require an escrow account, taken out of every settlement until a certain amount is reached. As stated, after quitting, they have 45 days to return this money to you.

The questions are, would you lease someone on and not have an escrow? Would you give them all their escrow money as soon as they quit? Would you have it so they could access all their money before they quit?

The answers is no. This money is to pay for any trailer damage, OSD claims, tickets, owed fuel taxes, unpaid permits and tags, advanced money, ect. Not everyone is honest. Many would grab every penny from the company, then skip on out.

I'm quite sure the hold backs at end of lease are clearly spelled out in the lease. Mercer has to do this if they plan to stay in business. Too many crooks that would take them for a ride.

Pete is talking about his maintenance escrow he set up with them to take x% from each settlement and set aside.

They also have a small escrow that you are talking about but it's real low like 350 bucks. I'm nut sure wht theu even bitter with that one, cause they fill it so slowly. I think the most they refer took from a settlement of mine to add to it was 1 dollar and 38 cents. It literally took 2 years to build that escrow up.

The people I always dealt with had a $1000.00 escrow that was supposed to cover anything owed when you left. It was something like $100.00 a settlement until all paid. It was irritating waiting on it, especially from the companies that didn't exactly adhere to the 45 day rule. I can understand needing an escrow though.

So, you're saying it's his escrow account for only his truck, and not for the company trailer? If that's the case, that's a whole different thing, especially if there was no minimum and maximum amount stated they would hold to cover anything that may happen to their lease trailers.

Im assuming it is an escrow he set up with them. Guess it could be the 100 bucks a month escrow they took for the trailer lease. I forgot about that one.

i read on an earlier post about turning the trailer in for extended time off. i live in tx, is there someplace in dallas or houston that i would turn it in at or would i drop it in Louisville? is it hard to get another trailer after time off? this would be for a van.
