    What's wrong with who? Prime or the "Drivers"?

    It's really clear that either you are a company driver (working for a "fleet owner") or you are an IC.

    Not to say I'm a fanboy of Prime. There must be some reason this has drawn out for so long... I'm just not sure how someone gets into that situation not knowing they are an IC and yet expecting to be an employee.

    If Prime had to pay at least minimum wage there is going to be a problem.

    Wife and I understood for the 306 days we were away from home with the truck in 2001 tax year we earned approximatley 4.52 per hour each. If Our employers had to pay us minimum wage (Which will NEVER happen...) they would have had to come up with another 70,000 dollars for that year.

    If they had to come up with 400 employees times that much, it will put them out of business.

    I am not bitter or angry. Trucking companies are not minimum wage companies. They are not overtime either since 1934 when the industry is specifically excluded from the new work wage hour laws of that year. IF trucking companies had to pay truckers what they are worth they would go out of business tonight.

    I don't mind having our apples from Yakima be 4.00 a pound if it will make sure that truckers who hauled it here from there are paid a good wage sufficient to thrive and contribute something to the economy rather than just existing. That was 20 years ago. Now I see many are expecting to gross 100K a year solo. Good luck with that.

    In a word, avarice.

    New Prime, inc. probably pays their attorneys hundreds of thousands of dollars in an effort to NOT pay their drivers.

    Heckuva business model.

    And Prime desperately wants arbitration because that will likely favor them and rules out any class action lawsuits.

    So long story short, guy does lease purchase with dreams of being an “owner operator” and getting rich, finds out that it wasn’t the case, and suddenly it’s Prime’s fault and not his for signing the lease purchase agreement? Do I have that right?

    These lawsuits is what created AB5. It's been a stretch since that lawsuit was filed. I am interested to see what happens. I see both sides argument here. It's so many gray areas that I dont envy the judge here. The guy who sued really wasn't an IC but a company driver that fell victim the fleece purchase......which is a scam. Then he signed an agreement to lease. Honestly, if I tend to side with the plaintiff if i had to choose. I'll be glad when all of this is clearly defined

    So, no personal responsibility falls on the guy for signing a contract on his own free will? It’s not the government’s job to protect everyone from themselves.

    I got a loan from the bank for my truck. If I don’t make my payments and I lose my butt can I sue the bank for giving me a loan?

    It really is the government's job to protect people from themselves. I side with the guy because these companies target people who are green, probably desperate to make big money. These people are trained to recognize folks like this. I hear of stories where dispatch starts to push leases on drivers, yet they never educate them on how to make money or the industry works. We try to warn people with regularity on TTR, but we can't make it sound as good as those crooks do. I am sorry sir. Government is necessary. We cant be trusted as civilians to follow the law, be ethical, make sound decisions etc..

    So where does it stop? Rent to own appliance companies? Store credit cards? Regular credit cards? Payday loan businesses? The only way people will stop doing dumb stuff with money will be the day that society is 100% cash based. No cash? Can’t buy it. Until that day, these poor desperate people that need the government to make sure they can live their life will continue to make poor financial decisions. Why would someone enter a L/P because they’re desperate for cash? A past history of poor financial decisions maybe?

    What’s the one thing we read on here time and again? I want to do a L/P because my credit is bad. A L/P isn’t the first poor choice someone makes in their life.

    If I go enter into a L/P and I know it’s a terrible choice can I sue later on when it doesn’t work? Or is that only for the desperate people who don’t know any better?
