No blood test without a warrant, per the Supreme Court in 2013, updating a 1966 ruling. And no blood test for a random drug screening for a CDL holder. Since LSD is the only major drug that can only be detected with a needle, that's the drug the smart druggies are using when they want to drive their truck around under the influence. Which probably explains that driver who was driving 2 mph in front of me through the Love's lot this afternoon.

Nah,he was probably out of hours. No thanks to FMCSA, the parameters on the ELOGS were reset,if the truck moves @ 5 mph,it either activates drive time or triggers an HOS violation.

You are correct about no blood test.w/o a warrant when under arrest for.DUI unless you have consent. An officer wont ask for a blood sample for alcohol..thats usually only requested if the DUI.driver is being transported to the hospital and cant take the breath test at the jail Not sure where you get your info about LSD. It is detectable in urine.

Yes, if they're looking for it and it has been less than about two days. But it is not part of the standard 5-panel test done for drivers, and it is expensive and rare for the test to be performed.

Does LSD Show Up On Drug Test?

Please note that I am not in any way advocating the use of LSD or any other drugs. I don't think drugs and driving mix, and I think if you get caught driving high, you should have your license revoked. (In other words, yes, I think 1/6 of the drivers in Colorado should be prohibited from driving.) My point is that drug screens have limitations, and this is one of the most obvious ones.

Since LSD is so rarely tested for, I think there are a few substitutes that could be used. For example, does your vehicle have a Grateful Dead or Phish bumper sticker? License revoked.

I got no issues with enjoying a beer, but ####...not while I'm at work. If you got problems that bad you need to be doing another line of work, or I dunno...rehab.

Yes, good point, LSD can rarely be detected in any random panel urine drug screen. I am referring to when a DUI driver is involved in an accident or incident and is arrested for DUI. If the commercial driver is involved in an accident and the officer believes he or she is impaired because of something other than alcohol ( negative breathalyzer reading for example) a urine sample will likely be obtained from the driver as long as that person consents. If that person refuses to give consent then a warrant will have to be obtained, which is rare in most cases. Usually when this happens the officer just has to go on his observations, witness statements, physical evidence etc. Most of the time this is enough as long as the evidence is clearly atriculated and a solid case

There was a time when law enforcement could ask the hospital to test for substances in the blood as long as the hospital was already drawing the blood for medical purposes, but that is no longer the case. Bottom line, if a commercial vehicle driver is involved in a serious accident involving injuries etc. there is a good chance the police will get that blood sample with or without consent ( with warrant if needed). All.kinds of substances show up in blood samples including LSD.
