30 minute break

    A driver on-duty for 11.5 hours and has 2.5 hours drive time left, he can't exceed the 14.

    I think you meant he was Off Duty for 11 hours?

    Well if he did, then it makes sense other than a 30 minute pretrip. BUT I am wondering because I saw the same type of question posted on another site a while back with the example being On-Duty.

    the 30 minute break is like any government rule ... simple .. what you guys fail to realize is the government is really concerned about your well being .. it is an all knowing and all caring government .. just remember that golden rule ... "you can screw some of the people some of the time ... but the government can screw everyone all the time ..... the 30 minute break is simple to figure out ... if you are hungry or need to stop for some reason it isn't time to take your 30 minute break .... if things are going good and your not hungry or tired and there really isn't a place to park or let alone eat it is time to take your 30 minute break ..... 2 , 15 minute breaks won't work because it would make sense but the government isn't in the business of making sense .... now if you are really tired and want to take a nap or just would like to stop and get a good sit down meal. ... that is a definite no no so they made the 14 hour rule to keep you going. . just always remember big brother is taking care of you the best he can

    The only time a person can take an on-duty rest break is when they are hauling 1.1, 1.2 or 1.3 explosives. Other than that they have to be off duty or sleeper for half an hour at or before the 8 hour on duty mark unless they are not driving after that point. You can work without driving for 14 hours without a break, but after 8 you need that 30 minutes before driving again. Also you can be on duty driving for 8 hours, then go on duty not driving for the rest of the 6 hours without a break. The 30 minute thing is only to give guys a break from driving during their shift.

    11 hours total for the day broken down as follows:

    0.5 - on duty
    4.5 - drive
    0.5 - on duty
    3.5 - drive
    0.5 - on duty
    1.5 - drive
    Equals 11 hours.

    So they changed the rule - no driving after your 14 is up?

    Using the original post, 11 on duty.

    yeah it may be confusing for some if your not used to the concept, over in Oz ( Australia) we've been doing this like forever i don't even remember when they first started the system its been around at least 20 years or more. So from when you start your time say 7:00 am a driver must stop and have a minimum 1/2 hour break by 12:00 pm which is 5 hours driving/ work, then the same process if you stopped for a 1/2 hour that'd take you to 12:30 you can now drive another 5 hours then another compulsory break is required by 17:30 pm take another 1/2 break takes you to 18:00 then one has 2 more hours to drive which takes them to 20:00 then he/she must be off the road resting for at least 7 hours before driving again. Unlike the 14 hour rule a driver here can take any length of break past the minimum and still continue to drive till they've done their 12 hours driving / work. Over there you could only have up to 3 hours break then it starts eating into your 11 hours driving time which is not fair.

    The driver's entire work day was 11 hours. He was "On Duty" a total of 11 hours.
    I've read and re-read the regulations and realized he THOUGHT he could log his break as on duty because they get paid hourly. He did not violate any HOS with the exception of his log. I showed him how to correct it and advised him when he should take breaks and how they need to be logged. You all are such a wonderful group. Every time i ask a question, I get all perspectives and I feel like that makes me better at my job.

    you have to log it off duty and if you are an hourly employee they do not have to pay you for any off duty time
