Yes you can be off-duty while in a dock.
Here's the regs from eCFR — Code of Federal Regulations :
All that has to happen is the motor carrier says you are relived of duty while the shipper/receiver loads you. Not even a paperwork requirement, but most do give a permission sheet in the permit book to make LEO's happy..

Have you ever been relived of duty while at loading or unloading? I don't think the motor Carrier can speak for the shipper or receiver. Let's say you want go walk to see a movie or go walk for long time and come back in a couple hours.
It clearly say "On-duty time means all time from the time a driver begins to work or is required to be in readiness to work until the time the driver is relieved from work and all responsibility for performing work"
How can trucking company relieve you from work while loading or unloading back up to the dock. They don't know what going on or if your help is needed and you can't leave. Your waiting in readiness to work once loaded or unloaded.Tb0n3 Thanks this. -
I agree with Brandt. You cannot log Off Duty at the customer. There was a carrier reporting his driver was given a violation for logging a 30 minute Off Duty break while being loaded recently. I stated if his driver had falsified a Sleeper 30 minute break there would be no violation. You can log Sleeper at the customer though, it is sort of an untouchable sanctuary no DOT officer can question, unless you were in there too long it brings up questions of where did you use the restroom stuff like that.

If you're helping loading and unloading you log line 4 till completed otherwise log 15 minutes which is the time it normally takes to check in the log line 1 till completed.That's how I've always done it and no DOT has ever questioned that.But your company may have a different logging policy its best to check with them.

Remember the truck driver in Florida that ran into back of a school bus stopped for letting kids off and he killed some teens because their was car of teen betweens his truck and bus.
If you remember he looked legal on log book. When the D.O.T found video of him actually unloading his truck because the receiver had video cams on the docks. They got him for falsified log book. When they added the extra unloading time he worked, they now got him for violation on HOS. He never should have been on that road and he killed some teens. It was all put back onto him and we was at fault for running into back of school bus and killing some teens. Of course he did not plan on that but it happened.
It was an accident at first, but when they found out he violated HOS it became a crime. He was working, so it's not the same as logging off duty and not doing anything, but technically your not off duty. Also if something happens and they think you should have been on duty your screwed. If your in the sleeper that 100% legal and can't be questioned unless they have video or witness to say otherwise.Rusty Trawler Thanks this. -
What if I am in Sleepbeath then I feel going for resting room then back to Sleepbeath ,will it be violating the 10hrs Sleepbeath?.

Sleeper berth. BERTH. Get rid of the A before you add the R, before you end up with Sleeperbreath.
10 hour break, log OffDuty. The only advantage that logging Sleeper is 8 hours allows a split log

You need 10 consecutive hours off duty/sleeper berth . You can break it up however you want, but if you are pogging sb, you must be in the sb. So if you get out, log off duty.

The shipper receiver or my carrier does not determine my off duty. I'm done until a few arguments with shippers because I asked for a eta, and it's usually hour and a half to two hours, I tell them okay I'm walking across the street to get something to eat. Oh well you can't leave though, yea yea I can leave. It's like they think that I'm asking them for permission, I'm just notifying them as a courtesy. Walk across the street to Burger King or McDonald's, order my food sit down and eat, play on the phone a little bit, then walk back to the truck and turn on the TV.
