Then the height of the load didn't interfere with air flow. If it did the RA would be higher. Just give the download to insurance and fight the claim.

I tell brokers before the contact is signed certain terms, or I don't want the load: product has to be cooled (exception is potatoes because they keep in sheds, but write the temp on bills); detention that I charge; lumper fees are paid/ reimbursed by broker; and no pallet exchange (don't see that anymore anyhow). This all, except for hot oroduct, has to be written on the rate contract. If the product is hot, I most likely won't load it. And be prepared to drive away.

Friends refrigerated box truck burned down that had a load of pharmaceuticals in it. The load was delivered by a tow company day after the incident , receiver tried making a multi million $$$ claim and claim got rejected because internal temp of pharmaceuticals was within range since they were inside a temp controlled container filled by dry ice…Last edited: Sep 15, 2025

My success rate with my approach might not be a good indicator for others because I mostly haul potatoes-being out of CO- when I am not on my regular run of pharmaceuticals. And backhauls are most often dry. However, I have found that with just about all loads, lumpers aren't coming out of my pay. I might have to pay them, but I get reimbursed. The same with pallet exchange: it's is non-existent anymore from my experience. And detention...well I always have it in the contract, but the terms can vary. When it starts, and how much $/ hour varies. It normally between 2-4 hours, and $25-$50/hour. The big thing is having it the contract, and getting a revised rate agreement reflecting detention to send with the invoice and Proof of Delivery. As far as pulping...I politely ask during negotiation if the product is pre-cooled, because, otherwise, I won't allow it to be loaded on my trailer. I pulp loads with a laser temp gauge when I can't stick it. I have even taken pictures of the temp reading, particularly when I have to wait in the truck during loading, and of course write the temp on the bills. The main reason I refuse to load out of temperature product is because it puts the compressor under a max load the entire trip. I once had cooling problems with a hot load of bell peppers coming from Laredo>CO, where the unit was shutting down, and I'd have to wait a couple of minutes for it to cool then restart. Once the outside temperature came down, it ran fine. And the customer received it. I refuse to haul out of temperature loads since that one.
