reefer claim

    i have question and i need some help i did a load from salinas ,ca to columbia ,sc lettuce the broker send the conf,telling as to set the refer at 34 continue ok i did all that i check the product when they load it the temp was at 38 ok they load it seal it ok i hit the road i got to columbia sc ,they unloaded proablem when they bring the paper work they said this accepted under protest due to freeze damage 7 pallets of arugula one frozen 229 cases of finish product frozen.ok i ask i need to see the product i need you to show me ,they said no, drivers are not allowed inside the warehouse ,the lady that bring me the paper work she said that they accepted so don't worry about it .then i left to termo king did a download check everything came out perfect the refer never went under 33.5 ,i did check the refer everyday at lest 5=6 times a day we send all the paper work to the broker,now after 3 weeks he said he needs another week for the claim .ok so here is my questions i did the download all good here i ask them to give me the damage product back they said no ,i ask them to show me the damage product they said no.i also had on the bill of landing 3 temp recorders one in the front ,one in the middle ,one in the back.the one in the back were the 229 case of arugula was it shows temp between 28-32 how is that possible ,the other ones they said was good.is this a scam?i want to thank you very much in advance for all the info.the broker is tw-transportation,spokane,wa.

    I would have never left the reciever without either going on the dock and inspecting product, or the product back on the truck.

    It's possible because to maintain a return temp of 34 the supply temp will sometimes be down in the 20's, especially when it's really hot outside. They call this "top freeze" because it will freeze the stuff that's closest to where the air first comes out of the chute. Some reefers have a produce setting so the supply temp won't go below 32.

    if any receiver says there is damaged product, or even fusses about the condition, and then refuses to allow you on the dock, first off, call broker, shipper, or customer, whoever is paying you... ask what they want you to do... i've had fussy receivers and I refused to get out of the door until the situation was resolved, especially when i was under a produce load. If they say they are refusing the product because of freezing, or temp issues, AND refuse you access to the dock to inspect product, and then keep the product, then OBVIOUSLY they are trying to pull a fast one and get some free stuff... If they are refusing it, and wont give it back, then they had better sign off on the BOL that they accepted the product, if not, PUT IT BACK ON THE TRUCK. Worst comes to worst, let it thaw a little if it froze, and go sell it to a produce market, then you have some money to put towards your deductible when they file against your cargo insurance.

    First thing get the broker involved. If you don't think anything is wrong with the product get USDA involved. They make the determination if the product is still #1 or has been degraded. If you're at a decent size market it doesn't take long for them to determine,if it's a grocery receiver they may not make it that day. And you may have to pay if the shipper doesn't. On temp issues they don't have to give you the product,the shipper discounts it.(received under protest) What was the 33.5 reefer print-out? If that was the discharge temp your fine,if it was the box temp and the discharge was 30 or lower you most likely did freeze the top.

    yes it was, all numbers are very closed on print out like i said the numbers are closed to 34 because the manager of that termo king inspect all nr.trailer shut walls etc because i ask him to.i look at the nr.on the print out they look as they suppose to look.i have fax it to broker 1 hour after i did the delv.he said that everything is fine bat now we have a problem .i'm really stress out because of this .never have any problem in the last 4 years my equipment is very good condition .thank you all for the help.i really think they are trying to scam me ( broker& reciver ).

    Did you deliver to a market or grocery warehouse? Markets are more likely to try and get a discount than a grocery warehouse. If you are going to run produce this happens.

    mcentire foods ,columbia,sc it was a warehouse.ok let me ask you this if the broker don't want to pay what do i do take him to court ?because is a lot of money.i mean this guy has any chance in the court?i did everything right with the refer download.
