im working or a owner operator

    ok if the truth must be told i have a criminal record and not much experience but a guy who owns a few trucks gave me a shot....most bigger companies wont touch me and got sent home from two others due to my past...here is my questions..besides getting screwed over from another small company i worked for...this guy is paying me on a 1099 but had me start a corporation w/ a tax ID and business account...other jobs on a 1099 dont do that so why is he? what type of taxes will i owe at the end o the first year if i make 50-55k? he is paying me .42 a mile with .45 in 6 months but wants me to run illegal and when im stuck in a door for 4.5.and 6 hours he doesnt pay waiting time or breakdown pay (i broke down twice in a month)is he screwing me and i dont know it...it feels like it. also he is making me pay or some occupational insurance at 200$ per month....is this normal? believe me i know how hard it is to run a truck and compete for loads....i want my own truck someday but is this the norm for when you hire a driver? or even more important is he treating me fairly?

    Well basically he is running you like it is your truck and trailer, the occupational insurance is like your workmans compensation, yeah you're getting screwed on that end, as it is his truck and always will be his truck, but as long as you're making money, he gave you a job when others wouldn't, take it with a grain of salt and save up your money and get your experience and then you can have your chance to own your own truck someday, and then at least you already have your corporation with tax ID and business account opened and ready.

    When you were making license plates did they pay on 1099? You got to figure you are going to start on the bottom not the top.:biggrin_25513:

    Tough spot. You've got 2 choices imho. Stay and save up for your own rig or quit the industry.
    Stop worrying about getting screwed, bring home the money that you need and be goal minded, still no one else would give you a chance. Take care of that license.

    fairly simple here -

    he wants you to start a corporation because he can treat you as a independent contractor even though you dont own the truck. BTW.. it is a smart idea ;) (TAXES WISE). for his benefit? i'm not really sure. the occupational hazard insurance is a no brainer. if the company doesnt have workers comp then they have to have occu insurance. this is the drivers and owner operators responsability (used to be $35 here until company forced workers comp) its paid on our behalf now.

    listen man, #### is going to be tough for people like in your position. run illegal? most do it. do you want too? probably not. do you have too? sometimes.

    now... WHAT KIND OF "ILLEGAL" running are you doing? there's a fine line in my opinion. are you working over 14 hours everyday ranging upto 24 hours? are you ripping out looseleafs left and right to make a run? or are you one of those type of drivers who wants to shut himself down 3 miles away from the reciever until he regains his 10 hours. (this happened here with a driver at this company, lol).

    thanks for the advice and good points...the funny thing is i asked the same questions in a couple other "forums" and people told me to run from this job...its good to get other perspective and i am lucky to have a job...and fyi i have been screwed before-cheated out of money and driving unsafe equipment ect ect....my licence is the one thing i have and im trying to change so running illegal is an issue....although NOW THAT I KNOW HOW TO DO IT CORRECTLY....should i at least push for some type of detention pay if im in a door 4-6 hours?

    what do you do? intermodal or reefer?

    edit: well, if you're working intermodal then typically 2 hours after you are there.. detention kicks in.
    if you're working OTR.. i dont know how that works. i guess based on the company.

    basically i am delivering in the morning....6-8 am depending on shipper then waiting or a load usually 1-3pm then driving 300-450 miles..why detention is killing me so 18 hours to 20 hours is the norm with a nap if lucky ...ill be the first to admit it dont know the industry....why im asking...the alternative is back to the streets or burger king-if im lucky-so i can tough it out i just want to know the good the bad the ugly

    Dont know the ins/out in the USA, but in the cold north (Canada), if you do not own the truck, have no ability to decline a load or route, you are considered an EMPLOYEE and shall be compensated as such.. Even if you have your own Corp... You are not independent!

    Having said that, your decision on what you do, at least you are not sleeping on the range and looking for the "6"...
