I am posting this for the poor guys that work for this gentleman. He doesn't pay his owner operators. And his company guys he pays them a straight wage and at the end of the year they find out that there isn't any taxes taken out. Well according to the IRS if he puts the company guys in his trucks he has to take out taxes and he thinks he doesn't have to, so beware of this company.

Depending on how he is filed with the state that he is in, he may have it set up to where he "contracts" employees to drive. This allows him to 1099 his employees instead of taking out the taxes. Basically comes down to him being lazy and not wanting to do the work or pay someone to do it.

No it doesn't. This subject has been discussed in length many many times. Driving a company truck you can not be a 1099 employ. Do a search for threads on the subject.

I talked to an accountant in his state and he is doing a big no no. In his state if he owns the truck he has to pay in the taxes unless he is leasing out the truck to the guys and he is not doing that because then the pay would fluctuate based on the loads they haul.
