Truckstops in Matthews MO

    Stopped at the J here this morning for fuel stop and to grab a bite. First thing I noticed was although the roads were clear, and to he pumps in the auto areas were clear at both the Loves and the J, the fuel pumps and parking lot were a sheet of ice at both places. Totally untreated....couple trucks were having trouble getting going and a wrecker was out there hooked up to one if the megas who was hopelessly stuck. Chatter on the radio said the TA was exactly the same. This seemed peculiar to me and after filling up and finding a safe, relatively dry spot that somebody must have just left I went in to eat.

    During the course of my meal I was chatting with the waitress and mentioned the lot. She told me that the J will no longer treat the lot because 8 years ago a trucker slipped and fell and successfully sued. Apparently the legal advice they were given was that when the lot is treated then there is reasonable expectation that it will be done correctly and thus the company is responsible for slip and falls. However by not treating the lot there can be no reasonable expectations and this they aren't responsible. Seems crazy to me but apparently the other truckstops have followed suit. I have a call in to corporate to find out there stance on this but I'm not holding my breath.

    Anyway word of warning if you stop at these locations after a snow/ice storm

    I'd heard that even as a kid in regards to shoveling your sidewalk or driveway, too...slip and fall on a cleared path and it is negligence for not doing a "complete" job, where slipping and falling on a snow-covered path was an "act of God" and you're on your own. When you're a big company with deep pockets, you try to limit your liability any way you can. If that also saves you money by NOT having to pay the plow guy or buy salt to treat the parking lot, you save even more.

    Personally, I always carried my old metal ball cleats in the truck with me in the winter for times I had to work in an area with a slick coat of ice. I never worried about a plant manager telling me I had to wear boots, because the greater safety risk was the lack of traction. If they wanted me to wear my boots, they needed to clear the ice. This winter, though, I found some cleats that strap on over the soles of my boots...and they take up less space in the truck than the extra pair of shoes....and my feet are MUCH warmer in my boots than they would be in the ball cleats...so it was worth the $7 or $8 it cost me to buy them.

    Now insurance companies don't refer to it as an "Act of God" because they said, "Our God is a good God and he wouldn't do that." -No lie.. now they call it an, "Act of Nature" and say that since you tried and clear the ice/snow you've assumed responsibility and it's your fault, but don't mess with it and it's an act of nature and you should have been more careful and don't go highstepping across a parking lot of ice and if you hit the ground, next time maybe you'll have learned a valuable lesson that nature is.. cruel.

    I thought the Flying J story went like this: A driver got out of his truck at the fuel island, no adverse weather involved and slipped on the oily residue at the fuel island. If you notice, they used to be totally anal about high pressure washing the islands at Flying J, although Pilot has dampened that a bit. They also used to have signs, maybe still do that say
    " YOU ASSUME ALL LIABILITY FOR INJURY IF YOU EXIT THE CAB" or something similar. Apparently if you thought the area was still slippery, I guess you could call the manager and ask him to clean the slippery spots maybe?
    The ice and snow on the parking lot, walkways. etc. I am no lawyer, but if it has snowed there is an expectation of a slippery surface. You can try to sue for any reason, but most lawyers on a contingency basis are going to look at the suit and say I can't win that one for you and get my 33%. Bye. Call one of the 800 numbers on the TV right after Judge Judy

    See Studebaker Hawk, there you go again using personal responsibility and common sense! We're talking lawyers here. All that goes out the window!! LOL
