Can I log this off-duty?

    My trainer is very good and he's remained a friend of mine. He's the reason why I've been able to stick it out so long and why I've been successful. I wouldn't call him clueless. He's just the victim of the ever changing rules/regs within this dynamic industry, and at worst this is just one rule change that has slipped by him.

    I just phoned him and told him he was incorrect and read him the FMCSA rule regarding this.

    Seems to be some slight confusion going on here between the definitions of ON DUTY DRIVING and ON DUTY NOT DRIVING. ODD is 11 hours max per 10 hours off duty. ODND is 14 hours per 10 hours off duty. Happy 4th!!:biggrin_2551::biggrin_2551::biggrin_2551::biggrin_2559:

    13.5 hours now. Got that stupid 30 minute break that doesn't stop the 14 hour clock. So 13.5

    If you log it as off duty you have to take 10 hours off.. You would log it as on duty not driving or sleeper berth.

    The key word for off duty in a commercial motor vehicle is if it is PARKED.

    My company is telling us if the customer wants us to be detained in a waiting room lounge we must log that as On Duty.

    If the customer says wait in your truck and watch the green and red lights, On Duty.

    If they say wait in your truck and tune to a specific CB channel-- On Duty.

    If they say drop your trailer in the dock and park in a specific area on the property-- On Duty.

    My company prefers us to bobtail off the property or walk off the property to log Off Duty.

    In rare instances we may log Sleeper if we are truly in there and otherwise relieved of Duty by the customer.

    well only 12.5 with your pre and post trips
    and another .25 for fuel
    and those pesky shippers and recievers
    take up so much time

    It's my understanding that you can log 15min on duty, then log off duty while being loaded/unloaded. This only really helps your 60/70 since it won't stop the 14 hr clock.

    You mean to tell me, that you can arrive at the shipper, check in with the shipper, open the doors and back in and chock the truck in under 15 minutes?

    Not always, but at the shipper I go to I can, because I don't have to check in to back in to a door. I can back in, then check in and i'm done until they call me on my cell.

    In an audit,

    the key words will be "geting paid".



    If you are getting paid for that time,

    we were told it must be logged as working...i.e. on duty, not driving.
