screwed by DOT rules and regulations

    If he did the test at the job site, most likely it was not a DOT required random test but just a random test, which every employer is entitled to do at any time. However, they can not put this on his DAC record for future trucking jobs, they are only allowed to report on failure or refusals of DOT required tests.

    No, this will not cause his CDL to be suspended, the drug test results are not reported to anyone other than the employee and employer and released to future employers. We do not have a national clearinghouse for drug test results yet, nor are any state licensing agencies notified.

    Lastly, if the company your husband used to work for is using this as a DOT test, they are not following the rules and most likely will not be reporting to DAC or any of the other job reporting agencies, sounds like they are a fly by night operation. Could the test been required by the company they were contracting with? You mentioned it was a new Haliburton site and everyone was tested, so did Haliburton require a non-cdl test at the start of the project? If they did then this test can not be reported as a DOT test and if it did show up as a refusal to test on either his DAC or a reference verification to a future employer you would have a law suit for sure.

    Oh, and for everyone that said demand a blood test, 40 CFR (drug testing) regulations do not allow for anything other than urine, even the companies doing hair follicle testing still have to collect urine samples right now, the hair is a non-dot test for their use only and can not be reported to anyone outside of the company, nor can it be used to invalidate or validate the urine sample tests.

    I say good luck with the new job and good riddance to the old job. I hope he has found a better service company to work with, 14/7 schedule is not that bad, especially if they give you 40 on your 7 off, you can make some good money.

    I agree, if they did the test as described, there is a big big problem using it for any federally regulated occupation because of the breaks in custody.

    What they checked on another drivers test form is step 1 - is DOT and FMCSA and on step 1 - G so I think they are trying to pass it off as a DOT test.

    Plus we drove by the address listed as the collection site it appears to be the secretary's house and the number listed as the phone number for the collection site is the secretary's cell phone number as well.

    blood pressure meds in general have diuretic, which increses urine, fluid rentention cause bp to go up

    so you are saying all medications are bad? insulin shouldn't be taken by diabetics for example? if so what is your cure for diabetes requiring insulin?

    and do you have a cure for rheumatoid arthritis? please share that one.
