Going back to OTR with Schneider Lease Purchase!

    My life just keeps getting better and better.

    Schneider regulatory called me today to ask about my citation and the circumstances surrounding it. During the conversation he told me that both the stop sign warning and the suspended while driving charge add 39 CSA points to my license. Despite that, if found guilty of the suspended while driving charge, Schneider will still allow me to be an IC. Now, that's the least of my worries.

    Regulatory gave me the number of a CDL protection plan whatever and I signed up, in hopes that they can help me fight off this ticket. I then called their customer service. They told me that because the citation was issued before I signed up, I would have to pay 66% of the attorney fees. That could add up to thousands of dollars that I don't have, so I basically just wasted $37 of my wife's money that I had to borrow to sign up for this service. Now I'm back at square one. Being unable to afford an attorney, I'll just have to defend myself.

    Tomorrow morning I'm going to deliver in Joliet IL, then bobtail out to the courthouse to enter a not guilty plea and receive a new court date. I'll have to cancel my Bolingbrook pickup to do so, but of course that's my luck as of late. I guess it'll be another $4200 week if nothing goes wrong, but let's be real, something is going to go wrong. I've only been 27 for 4 months and it's already the worst year of my life.

    Now when my court date eventually comes, I'll have to somehow convince the judge that I did not know my license was suspended on the day I received my citation. I did receive a letter, either from AZ DOT or somewhere else telling me that I needed to renew my background check to keep my HazMat endorsement. I don't remember there being any description of repercussions should I fail to do so. Which means I could use that letter as evidence to prove I was not informed that my license would be cancelled. Without this information, and being overwhelmed by getting fired, looking for new work, figuring out my financial situation, and moving from Arizona to Utah, I put the background check on the back burner until it eventually lapsed. If I can have my charges dropped or reduced, then I'll be successful and I can put this behind me.

    But, again, let's be real.
    We are truck drivers.
    The general public does not like us.
    Law enforcement does not like us.
    The government does not like us.
    And seeing how our employers categorize us by number instead of by name, they don't care about us.

    Now that I've painted the picture for you, the judge will find me guilty, if only by my dark skin tone alone. And in the state of Illinois, conviction of driving a commercial motor vehicle with a suspended, revoked, or otherwise canceled CDL means they are required to revoke my CDL for 364 days. Also, because this is an Illinois Class A Misdemeanor, the maximum penalty is a year in prison, a $2500 fine, or both.

    Setting aside prison time or a fine, having my CDL revoked would be the worst punishment. Being unable to drive means Schneider and SFI would terminate my lease and take my truck. And with additional fallout coming from my personal finances, I will have lost my house, the wedding party, my car, my wife's car, and everything else in bankruptcy court by the end of summer.

    I'm not mad. I'm not sad. I don't feel anything. Maybe because I knew it would all come to an end. Everything I've worked so hard to grow and maintain over the last 6 years, will all be undone because of a lapsed background check and a stop sign.

    Sadly, they lot's of times say, "Negligence of the law isn't an excuse." However, I've run into some nice judges before on minor things. So if you are polite and respectful. You might be surprised as to what he does. Perhaps they'll keep the stop sign and throw out the suspended. Good luck.

    Holy Lord! The color of your skin doesn't have anything to do with your incompetence and the situation you find yourself in. You did that all on your own without any help.
    I would advise you to get busy fixing your problems instead of writing a sad novel about it. I know I sound like a ### hole, but you need to get cracking on what really matters. The rest will fall into place.
    1. Pay attention to detail.
    2. Stop blaming others.
    3. Refer to 1 if in question. This industry is unforgiving to those who don't.
    Some sound advice has been given to you by others in this thread. Your problems in the grand scheme are kind of petty. Predicial judges who don't like truck drivers didn't create this.
    Lapsed background check didn't do this to you. ##### did. And by God it must be really good to put yourself through this.

    Patrick...take all possible documents with you and meet with the prosecutor tomorrow. Ask to see them or go to their office and explain the situation. They are not looking for situations like yours. They want the habitual traffic violators, repeat DWIs and other scofflaws who flaunt the systems. You should have no problems getting this dismissed.

    I am a retired detective. First contact the court and ask for an adjournment so you can contact the district attorney's office to work on a plea deal. You can do this on your own. You do not need an attorney.
    Call by phone and ask the process they require to accomplish this. It may be just the call or it may require a written request. Ask for the name of who you spoke with and if they can send your new court date in writing.

    Second, find out what district attorney's office covers the jurisdiction you received the ticket in. Normally the county is listed on the ticket. Then find out what their process is to request a reduction for traffic offenses. Usually this info can be found on their web site. It normally involves writing a letter to a specific address with your personal situation and why you are asking for the reduction. They may ask for you to submit a copy of your driving record which can be obtained from the state that issued your license. Obviously the less tickets in the past the better.

    As far as your letter, strike a conciliatory tone, don't blame the system or the police or anything like that, explain the situation regarding your license along with the fact you took prompt steps to rectify the situation. Submit whatever written proof you have supporting what you did and that your license is now reinstated. Conclude with asking for consideration in the matter. Explain that you travel for work and maybe they can reply via email as well as sending you the normal hard copy letter to your mailing address. I would send any correspondence via certified mail so you have proof. Also tell them when your next court date is. They should reply with what their offer is and instructions on what you need to do to finalize this. If you aren't sure what you are reading or are not clear on what you need to do, ask questions. They key is communication and staying in contact with the court so they know you aren't ignoring the ticket. Good luck.
