No, I was never in any accidents the only driving i did was around the yard and a little highway driving and I passed their road test, they even practically begged me to stay but my mind was already made up, maybe thats why they put that on my dac.

Well thats a toughy. Get an attorney to call the company and threaten to sue for defamation of character, and slander. IF you can find an attorney who will take it. I am going through something similar with another company over Job Abandonment. When I can prove my wife was incapacitated due to a miscarriage, had surgery and I had to be home to take care of her. Or at least be local anyway.

I paid for my own CDL School and trained with Stevens Transport for 2 months. I had 5 seperate trainers in 2 months and they negated on their numerous promises to allow me to get home for Christmas. Instead, 2 days before Christmas they had me on a truck to Utah and I live in South Florida. Anyway, at that time I left. In the subsequent months, they called me and called me and I did not want to go back. Their last call was a threat to injure my DAC Report, which I really did not know too much about.
I have a question on the time limit Stevens Transport had to file a DAC incident. What they did was clearly retaliation..and had I gone back they would not have made the entry.
In my first month of training, under their trainer's direction, I had to get towed outof some sand. They reported that to DAC as an accident. I was told that any incident requring over $600 in a towing expense can be reported to DAC as an accident.
Subsequently, I have applied for dozens of driving positions and have been checking clean driving record, no accidents. When they called my into the office upon return to Dallas from that incident, they made no mention of reporting to DAC.
Were they allowed to report a towing incident as an accident ? If they reported the info to DAC in Feb 09 and it happened in Nov 08...did they violate some typr of time limit? And is there anything to help protect me when I am in training?
    Thank you.
I would appreciate some guidance from those who have been in my shoes.

In trucking never plan on anything going the way you think it would in the real world. As a New Driver, I wouldn't plan on things working out the way you want until you get some time in. I have a friend in Denver that spent one year with Stevens-he had a hell of a time getting away from a trainer-not because he was a bad driver-because they were milking him for cheap labour.

For the Sand-Incident: they can put it on your DAC, the question is how did that occur? I will have a better answer for you for more details. Mostly likely it was put down as a Preventable Accident-then therefore on your DAC it went. Most companies would not be surprised by an accident by a new driver.

No matter how Stevens was- you should have stuck it out for at least 6 months as long as you were being paid a decent wage. Having a shaky work history and for the reasons given in this economy will make it difficult. Also, keep in mind in length of time between trucking jobs (especially for a new driver) will hurt your chances of being hired.

As for the time limit- that was prolly due to your last call with them and I doubt that it would have been on your DAC if you had spend more time with them. Also, did you sign any kind of contract? Tuition reimbursement agreement? Anything along those lines?

Man, that's a tough part of florida if you have a good DAC. Try your small companies that don't use Dac, is all I can suggest. None of the bigger companies will touch you that I know of. Small company for a good year will help you. Good Luck........

Burning through 5 of their trainers (I'm surprised they even LET you do that) and after that, worrying about getting home for Christmas after that didn't make you their favorite newbie, and they probably figure they were doing other companies a favor getting you out of the industry. (they COULD be wrong, but be honest with yourself, is this really what you want to do? Are they right?)

You spent the money before you understood what you got yourself into. Getting home is a concern, but in your first several months, it should be one of the least of your concerns. Sorry to not show you much sympathy. You can put a refutation note on your DAC, but it probably won't help you much. I'd look for local/regional class A or B. Not likely that any of the bigs will touch you for OTR.

OK, first of all, you're in a terrible location to get a trucking job. FL is bad, southern FL is extra bad. however - check out some of the comcar companies - they have lots of FL stuff.

second, if you wanted to be home (for Xmas - or any other reason,) trucking is NOT for you. you have to work when the work is available. regardless of what a trucking company might "promise" you, they have a business to run. what were they supposed to do, put you on a bus in utah and pay several hundred dollars to send you to florida, just because you wanted to be home for the "holidays?"

3rd - DAC is an unregulated scam which will be gone in a matter of time. truck drivers are not going to put up with this nonsense much longer. I was stuck about 4 times with the first company I worked for (flatbed.) I went where they told me to - was pulled out with the fork lift. never a reason for it to be reported to the company. if you got stuck at the direction of a trainer or customer - you have NO responsibility whatsoever for this. you should write a letter to DAC disputing this entry and demand that it be removed. any company can report any kind of BS to DAC any time they want to. as I said, there are no checks and balances for this "service." someone may bring up "fair credit reporting," or some other nonsense - good luck with that.

but with only 2 months experience (almost a year ago,) it would be extremely difficult for you to get another gig even in a good economy if you lived in a better area of the country, but things being the way they are - I'd say it's very possible you wasted a good sum of money on whichever prestigious trucking university you attended.

That phrase explains what WOULD have been reported IF there were any.....they put a 0 in that field.
You're fine. Reading comprehension is a wonderful thing. ;)

PS: Some truck drivers yell when people do stupid things. They shouldn't. Get over it.
