Sorry not true
DUI is a state law, and even though you were on private property, you were in physical control, and had access to any public street. You had to drive to that location, or were going to leave to get to another
Most states the courts have said that keeping the public safe from drunk drivers is of the utmost importance so the DUI charge can and does extend to private property.
In my state you need not have even had the car running and you could have been asleep in the back seat and the arrest would have been good

Good thread......
Back in another life...in my construction days.....
Pacific Bell had their "Jamboree" at the L.A.P.D. training Academy.....
Basically it was one big "backyard Bar-b-que" with Pac-Bell employees, management, Contractors, city inspectors....ect.....
Card games, horseshoes......and joining in on all the fun....L.A.'s finest would pound down the beers "one for one" with us......
It was ironic that those who are paid to enforce the laws got just a toasted as us "civies"...... -

Here in Florida you can and will get a DUI on your own property. If you are in your garage having some drinks while working on your car and someone calls the law and that vehicle is running or has a hot engine...you are going to jail if over the limit.
Doesn't matter if you have 200 acres and you are in the middle of them.Baack Thanks this. -
When's the next rocket to to Moon?.......The earth officially sucks......D.Tibbitt, Gearjammin' Penguin and AnotherFool Thank this. -
I was a cop here and argued tooth and nail with my instructors over that one. I think it is BS if I am at home and the vehicle hasn't left my property but it's the law. You would be AMAZED how often it happens here too! -
